Temporary Easement Description: Triangle Warehouse (2500 Walnut Street) <br />Commencing at the SE corner of subject property as the point of beginning; thence <br />westerly along south property line a distance of 15.00 feet; thence right at 900 for a <br />distance of 5.00 feet; thence right at 900 for a distance of 15.00 feet more or less to the <br />easterly property line of subject property; thence southerly along the easterly property line <br />to point of beginning and there terminating. <br /> <br />Subject property Description: <br />That part of Section 08 Township 029 Range 023 described as follows: The Southerly <br />935 feet of the Easterly 314 feet of the Westerly 1084 feet of the Northwest quarter of <br />Section 08 Township 029 Range 023; subject to roads and easements. <br /> <br /> <br />AND WHEREAS, the City has been unable to agree on a negotiated amount for some of the <br />easements to be acquired; and <br /> <br />WHEREAS, under Minnesota Statute 412.211 and Minnesota Statute Chapter 117, the City has <br />the power to take and acquire easements by way of eminent domain; <br /> <br />NOW THEREFORE, BE IT RESOLVED; by the City Council of the City of Roseville, <br />Minnesota, that the City of Roseville hereby deems it necessary and convenient that permanent <br />and temporary construction easements as described be acquired by the City of Roseville for the <br />purposes above described. <br /> <br /> <br />BE IT FURTHER RESOLVED: that the City Attorney be and hereby is instructed to commence <br />the necessary proceedings in condemnation under the power of eminent domain in the name and <br />in behalf of the City to acquire such easements. Further, because construction is scheduled to <br />commence in May 2005, the City Attorney is further directed to use the "quick-take" procedure <br />under Minnesota Statute 9 117.042. <br /> <br />The motion for adoption of the foregoing resolution was duly seconded by Councilmember <br />Schroeder and upon a vote being taken the following voted in favor thereof: Kough, Ihlan, <br />Maschka, Schroeder, and Klausing, and the following voted against the same: none. <br /> <br />WHEREUPON, the said resolution was declared duly passed and adopted. <br />
