<br /> <br />The written information that I have seen from city staff as to whether this project is in <br />compliance with this ordinance does not indicate that it is in compliance with the shoreland <br />ordinance. The response that I have heard repeatedly is that the project will use a PUD to bypass <br />the Shoreland Ordinance. The DNR, in its response to the AUAR, was specific in is position that <br />Roseville was not to use a PUD to bypass the Shoreland Ordinance. <br /> <br /> <br />There are two defined areas to be considered in evaluating the Shoreland ordinance. One is the <br />Shoreland Management District. This district is defined as: <br /> <br /> <br />by <br /> <br />The second area is the Shoreland Overlay district. This district is defined as: <br /> <br /> <br />Shoreland is defined as <br /> <br /> <br />There is an indication in the report by the city staff that 1000 foot requirement can be reduced. <br />This is true. But the requirement is that Roseville can request a reduction in the distance if there <br />is a topographic feature which lessens the impact of the whole area on the lake. This reduction <br />can only occur if it is approved by the MnDNR commissioner. It cannot be done simply by city <br />staff choosing to reduce the distance. <br /> <br />Such a change, I believe, could only occur if the city council were to pass a resolution requesting <br />a change in the area defined as shoreland in the vicinity of Langton lake and if this request were <br />then approved by the MnDNR commissioner. I do not see in any of the requested actions, for the <br />city council to take tonight, any such resolution. <br />
