<br />Even if there was such a resolution and it was approved by the MnDNR commissioner, all of the <br />areas that drain into Langton Lake would still fall under the designation of Shoreland out to a <br />distance of 1000 feet from the lakeshore. <br /> <br />Since there has been no application to the MnDNR commissioner to apply for a change in the <br />1000 foot limit nor has this action before the Roseville City Council granted authority to apply <br />for such an action, then the PUD regulations that reference this area still apply at the full 1000 <br />foot limit. <br /> <br />The requirements for a PUD in the Shoreland Ordinance specifically applies to the area defined <br />by the overlay district (also known as the Shoreland District) not by the Shoreland Management <br />District. This requirement is given in section 1016.24 section D is: <br /> <br /> <br />It repeats this statement in section 1016.24 section E: <br /> <br /> <br />(30% ) <br /> <br /> <br />Note that the requirement applies to developments within the overlay district not to the shoreland <br />management district. <br /> <br />In the PUD density and open space requirements it again specifically states that this applies <br />within the overlay district which is all land meeting the definition of shoreland or that land <br />within 1,000 feet of the ordinary high water level. There is no reference in this portion of the <br />ordinance to the shoreland management district. Also, the term" shoreland district" is defined in <br />1016.12 as being the Water Management Overlay District not the Shoreland Management <br />District. <br /> <br />These requirements apply to all PUD's built within the vicinity of a designated lake in <br />Roseville. There is no exceptions that allow this ordinance to be waived when the development <br />is done using a PUD. <br /> <br /> <br />or <br /> <br />There are two sets of requirements that must be met by a PUD within this shoreland overlay <br />district. The first is a maximum floor area coverage. There are two sets of definitions, one for a <br />residential PUD and one for a Commercial PUD.
