<br />City Council Regular Meeting - OS/23/05 <br />Minutes - Page 30 <br /> <br />Councilmember Schroeder opined that the proposed ordinance <br />was being modified back to state statue language and created a <br />lot of work for no purpose. <br /> <br />Roll Call (Ihlan Amendment #2) <br />Ayes: Maschka; Ihlan and Klausing. <br />Nays: Kough and Schroeder. <br /> <br />Discussion ensued regarding whether or not to consider <br />Councilmember Ihlan's Amendment #3. Councilmember Ihlan <br />deferred to Councilmember Kough related to this section. <br /> <br />Councilmember Kough advised that he would not support the <br />proposed ordinance, as amended, with language remaining in <br />Section 501.16, Subd.2b, specifically related to an animal, <br />. . . "when unprovoked, chases or approaches a person, including a <br />person on a bicycle, or other wheeled conveyance (such as <br />skateboards, scooters and the like) upon the streets, sidewalks, or <br />any public or private property, other than the animal owner's <br />property, in an apparent attitude of attack; or..." <br />Councilmember Kough opined that this was addressed as a <br />violation of the City's leash law; and was a common reaction of <br />a dog to follow moving objects; and could be deemed aggressive <br />or look vicious when the animal was only expressing fear or <br />curiosity. <br /> <br />Discussion included definition of "an apparent attitude of <br />attack;" the language related to public property and private <br />property; <br /> <br />Councilmember Ihlan concurred with Councilmember Kough; <br />noting that her proposed amendment #3 was to remove the <br />potentially dangerous animal references and Section 2 in its <br />entirety and to focus on dangerous dogs; as an additional <br />enforcement tool for City staff to enhance the leash law and <br />license and vaccination laws. Councilmember Ihlan opined that <br />this section didn't add anything to the proposed amendment with <br />the exception of obedience; and spoke in support of enforcing the <br />City's existing laws. <br /> <br />Ihlan moved, Kough seconded, Councilmember Ihlan's <br />
