DaTE: �ay 12, 1975 DEPT.HEAD APPROVAL. � �� MGR. �tEVI£WED/ RECQMMENpS : On Apri.l 14, I975, the Council authorized awarding this year's street depax�ment bituminous blacktop mixture proposal to Ashhach Canstr�ction Company as the Lowest of the four bids received for this years' patching marerial. Upon contact with the organization last week, ho�ever, it was discovered that thei.r bid was predicated upon using an asphaii.ic concrete fo:M[�n q� a,aatcl�ing u,aterial, ra�her th.an a MC mix which is usecl by i�oseville. A review of the MEID Specificatian utili.zed in this bi.dding showed that Ashbach Construction was indeed cozrect and �hat asphaltic concrete was permitted to he used in the specifications and, there- fore, thep bid in what Ghey believed to be a proper fashi.on. The matter was discussed with their iirm artd it was iaund that to provide the MC nix desi.red ChaC they would have ta increase their price to cover their ex- penses. We reviewed this matter with aur legal advisors and ware informed that the appropriate actian at this ti�r�e would be to cancel the award Co Ashbacl� and rebxd the item. The most desirabLe da�e ta recezve �hese bids would be May 27, 1975. In �tze meantime the City wilL purchase it's blacktop material from the most in- expensive available source until a contracC can be awar�ed. This should not grove a particular handicap.
