<br />Regular City Council Meeting - 02/23/04 <br />Page 7 <br /> <br />appreciation to the over 150 volunteers, extra efforts of Championships <br />City staff, and to those Councilmembers and residents who <br />attended the event. Mr. Brokke noted that twenty-one (21) <br />different countries were represented at the event held at <br />the John Rose Oval. <br /> <br />5. <br /> <br />Consider the Request of Kara Rose for an 11 Foot Variance <br />to Section 1004.02D4 of the Roseville City Code to Allow <br />Construction of a Deck and Porch at 998 Brooks Avenue (PF <br />3556) <br />Community Development Director Dennis Welsch presented and <br />overviewed the request by Kara Rose for an eleven (11) foot <br />variance to Section 1004.02Dr (Comer Lot Setback) of the <br />Roseville City Code to allow the construction of a fourteen (14) <br />foot deep deck and porch, nineteen (19) feet from the west <br />(Aglen Street) property line. Mr. Welsch advised the Planning <br />Commission had approved the request on a 5-2 vote; having <br />noted the adjacent neighbor's concerns. <br /> <br />Councilmember Maschka requested clarification of concerns of <br />the Planning Commission related to precedent setting for this <br />type of variance. <br /> <br />Councilmember Kough requested comment from City Attorney <br />Anderson regarding legal issues related to this case. <br /> <br />City Attorney Anderson noted that, without an appraisal, it <br />would be difficult to address ramifications to the neighboring <br />home's market value. Mr. Anderson noted that there was <br />nothing in City Code that would guarantee anyone an <br />unobstructed view, and the applicant could at any time plant a <br />row of conifers that wouldn't have been regulated by City Code, <br />but would obstruct the neighbor's view. <br /> <br />Community Development Director Welsch noted that this <br />property was unique, and further clarified code as to front and <br />side yard determinations for comer lots. <br /> <br />City Attorney Anderson noted that, in looking at the definition of <br />front and side yards by code definition, the main door to the <br />house was on Brooks Avenue, while the Aglen Avenue was used <br /> <br />Resolution 10205 <br />Consider the <br />Request of Kara <br />Rose for an 11 Foot <br />Variance to Section <br />1004.02D4 of the <br />Roseville City Code <br />to Allow <br />Construction of a <br />Deck and Porch at <br />998 Brooks Avenue <br />(PF 3556) <br />
