<br />March 29, 2004 <br /> <br />To: Roseville City Attorney <br /> <br />From: John Kysylyczyn <br /> <br />CC: Roseville City Council <br /> <br />RE: Complaint to Council on Pathways Committee <br />violation of Resolution No. 9372 <br /> <br />Roseville City Council Resolution No. 9372 addresses the appointment process, <br />reappointment process, and term limits for all city commissions and other related <br />advisory groups and task forces. Recently, the City Attorney issued an opinion <br />which stated that this Resolution is still in effect. <br /> <br />It has recently come to my attention that the Roseville Pathways Committee is in <br />violation of this resolution. <br /> <br />The Roseville Pathways Committee was appointed approximately 10 years ago, <br />and continues to meet annually at a minimum. Their last meeting was held in <br />January 2004. Their meetings are held at public facilities, and include <br />participation and support by city staff. <br /> <br />The members of the Committee are in violation of the resolution for the following <br />reasons: <br />'" They have served for approximately 1 0 years without being subject to <br />reappointment (page 3) <br />of 1 0 years of service exceeds all term limit standards (page 3) <br /> <br />The Committee as an entity is in violation of the resolution for the following <br />reasons: <br />. No applications have been accepted in 1 0 years (page 3) <br />.. Opportunities to serve have not been advertised for 10 years (page 2) <br /> <br />In addition to the violations referenced under Resolution No. 9372, the Pathways <br />Committee also violates past practice of the Roseville City Council. No other <br />committee has ever existed which has granted members life terms without the <br />need for reappointment, and does not advertise or provide opportunities for new <br />members to apply. <br /> <br />In view of these numerous violations, it would be my f'ecommendation that the <br />Committee be disbanded and its members thanked for their service. <br />
