<br />City Council Study Session - 07/18/05 <br />Minutes - Page 22 <br /> <br />Staff had provided, as a Bench Handout, a Council Packet <br />addendum dated July 15, 2005, responding to Councilmember <br />Ihlan's questions and providing status reports and facts related to <br />the environmental clean up and remediation in place, or to be <br />implemented as the redevelopment project moves forward. <br /> <br />Mayor Klausing requested commentary from City Attorney <br />Anderson related to the authority of Cities. <br /> <br />City Attorney Anderson clarified that, in the majority opinion of <br />the Supreme Court, their decision has simply confirmed the <br />powers previously and historically held by cities in the use of ED <br />for economic development; and the purpose of government to <br />encourage development. Mr. Anderson cited several other <br />relevant cases. <br /> <br />Mayor Klausing noted that, while the City of Roseville has had <br />this authority for years, the use of ED by any past or present City <br />Council has not been exercised. <br /> <br />Councilmember Maschka concurred with Mayor Klausing's <br />interpretation of use of ED. <br /> <br />Councilmember Ihlan reiterated her request to engage in public <br />debate related to the use of ED; opining that ED would probably <br />be required in the Twin Lakes Redevelopment project. <br /> <br />Councilmember Maschka opined that, even within the Council's <br />authority, he would not condone the use of ED on a broad basis. <br /> <br />Mayor Klausing noted the affirmation of the Supreme Court of <br />the power available to cities; further noting that individual <br />Councilmembers determine whether or not to use ED if and <br />when it's brought forward, but noting that very specific criteria <br />had been outlined, particularly within the Twin Lakes <br />agreements, and that individual Councilmember values and <br />objectives would determine the use of ED. Mayor Klausing <br />expressed concern that this issue, as with the preceding <br />environmental issue brought forward by Councilmember Ihlan, <br />were a continuation of the rehashing of the Twin Lakes issue, <br />rather than a policy issue.
