<br />City Council Study Session - 07/18/05 <br />Minutes - Page 23 <br /> <br />Councilmember, with or without an ordinance or policy in place, <br />could change future decision-making through simple majority <br />vote, and putting in place such legislation would be ineffective in <br />the final policy decisions brought forward by individual <br />council members now or in the future. <br /> <br />Councilmember Kough opined that a newly-elected Council <br />would change any policy or ordinance to be less effective, and <br />was dependent on individual Councilmember philosophy. <br /> <br />Councilmember Ihlan opined that, with the recent Supreme <br />Court decision, the issue of ED was in the public eye, and now <br />would be a prudent time for discussion. <br /> <br />Mayor Klausing opened the discussion to public comment at this <br />time. <br /> <br />Al Sands, 2612 Aldine <br />Mr. Sands opined that the public wanted to know the feelings of <br />the City Council and how they would restrict ED; noting that the <br />state legislature would also be discussing this issue. <br /> <br />Dick Houck, 1131 Roselawn <br />Mr. Houck opined that the decision of the Supreme Court was a <br />mistake; and that the public wanted to know City Council <br />opinions related to ED as their duty as elected local officials. <br /> <br />John Kysylyczyn, 3083 N Victoria Street <br />Mr. Kysylyczyn opined that this was an important issue, from the <br />local to national levels; and addressed past Council action related <br />to the CenterPointe development; and encouraged <br />Councilmember to at a minimum discuss the issue with the <br />City's legislative delegation on an annual basis; and provide their <br />opinion on the two House bills that have been recently <br />introduced in a constructive environment. <br /> <br />Discussion included the mechanism used by individual staff <br />members at the time, given by the City Council, for considering <br />use of ED as a legal proceeding for use of property taken for <br />public purpose WITH compensation. <br />
