City Council Study Session - 07/18/05
Minutes - Page 6

Talbot were present to review and discuss long-standing code
issues. Mr. Welsch provided a Bench Handout outlining the
issues and concerns.

4.a

Discuss Business-Residential Conflicts on the South
Side of County Road C between Hamline Avenue and
Snelling Avenue
Staff reviewed the seven properties with six property
owners along the south side of County Road C between
Hamline and Snelling A venues. Staff noted that
complaints had been long-term, with no significant action;
concerned quality of life issues for those residential
properties abutting the industrial properties; involved
outdoor equipment and materials storage, odors, visual and
noise pollution, and a lack of compliance with Code
setbacks, screening, fencing, and storage. Staff noted that
due to these issues, it was possible that the abutting
residential property values were diminished.

Staff reviewed code issues and compliance concerns
related to setback requirements, screening, outdoor
material storage, Conditional User Permit compliance, and
other concerns.

Staff reviewed each property and code compliance issues
for each specific property, variances in place, and provided
pictures of non-compliance items. Staff noted that, while
the parcels only totaled nine acres, implications to the
abutting neighbors on the rear were substantial.

City Attorney Scott Anderson clarified the purpose and
intent and uses allowed in L-I Zoning Districts, and
perfonnance standards.

Discussion among staff, City Attorney Anderson, and
Councilmembers included compliance, former and
recently-adopted zoning and code requirements; estoppels
issues, and performance standards.

Further discussion included railroad property and
maintenance issues; noise and odor issues from the former

Business-
Residential
Conflicts on the
South Side of
County Road C
between Hamline
and Snelling
