<br />City Council Regular Meeting - 08/08/05 <br />Minutes - Page 8 <br /> <br />Cynthia White, at 2489 Churchill Street. <br /> <br />Mayor Klausing declared the motion failed for lack of a <br />second. <br /> <br />Maschka moved, Ihlan seconded, approval of an <br />Encroachment Agreement between the City of Roseville <br />and property owner, Cynthia White, at 2489 Churchill <br />Street. <br /> <br />Councilmember Maschka questioned whether the <br />landowner was actually at fault, or if the situation was <br />created when the City reconstructed the road. <br />Councilmember Maschka expressed his understanding of <br />Councilmember Schroeder's point of view, noted it was <br />an unfortunate situation, but opined that no one was <br />getting hurt either way, and in an effort to provide <br />resolution for the landowner, staffs recommendation <br />seemed appropriate. <br /> <br />Councilmember Schroeder again opined that approving <br />this request would establish a precedent. <br /> <br />City Attorney Anderson, when Councilmember Maschka <br />sought his legal opinion regarding precedent, opined that <br />approval ofthe request would not be setting precedent. <br /> <br />Roll Call <br />Ayes: Ihlan; Kough; Maschka and Klausing. <br />Nays: Schroeder. <br /> <br />4.c <br /> <br />Adopt Ordinance Updating the Roseville City Code to <br />Conform to State Law (former Consent Item 3.g) <br />City Manager Beets, as requested by Mayor Klausing, <br />provided an overview of the request for Council action <br />and staff report dated August 8, 2005. <br /> <br />Councilmember Ihlan noted that, while in theory she was <br />supportive of the requested action, she questioned <br />whether or not the scope of the current ordinance was <br />applicable to Roseville residents or all citizens, no matter <br /> <br />Ordinance No. 1324 <br />All Protected Class <br />Inclusion <br />
