Mr. Welsch noted the additional condition that a permit <br />would be required for any fence, regardless of height, along with <br />staff review of landscape plans at the time a building permit <br />would be issued. <br /> <br />Discussion included fence installation and whether prohibition of <br />fence construction could be made a condition of the variance; the <br />actual buildable area of the Lot; and the hardship definition being <br />the unique shape of the lot and demonstration that a house could <br />be built upon the lot with a variance, but not without. <br /> <br />Todd Iliff, Applicant, Representing Chuck and Sue Lesky <br />(in-laws) <br />Mr. Iliff spoke in support of the request, noting that until <br />recently, Mr. and Mrs. Lesky had lived on the adjoining <br />property, and were looking to sell their home and hopefully, a <br />buildable adjoining lot. Mr. Iliff advised that the applicant was <br />not interested in building a home, even though they had an <br />architect provide several design possibilities to assure the lot was <br />buildable. <br /> <br />Peter Zeller, 1773 Alameda Street, southwest of site <br />Mr. Zeller questioned the visibility issue for residents accessing <br />Dale Street. Mr. Zeller also questioned the location of the stakes <br />on the proposed lot, alleging they were actually only 10' <br />setbacks from Dale Street, rather than the necessary 25'; and <br />appeared to be in line with an existing fence on the property, <br />which may actually be in City right-of-way. <br /> <br />Further discussion included the actual stake location and survey <br />work done by a registered land surveyor; and the applicant <br />opining that a clear line of visibility existed for cars looking onto <br />Dale Street. <br /> <br />Councilmember Kough spoke in support of the request, noting <br />the unusual lot shape and right of the property owner to develop <br />the property. <br />
