<br />City Council Regular Meeting - 08/22/05 <br />Minutes - Page 31 <br /> <br />City Attorney Anderson recommended leaving the language in to <br />provide monitoring and obligations under a contract, as with <br />other provisions to provide the City additional leverage. Mr. <br />Anderson noted that the specific items were standard language <br />for RFP's and contracts to provide notice to a contractor of City <br />expectations and standards. <br /> <br />Further discussion included ownership, maintenance and repair <br />of recycling containers, impacts to cost comparisons, and single- <br />sort or dual-sort provisions. <br /> <br />City Attorney Anderson recommended an additional clause at the <br />end of Section 5.05 addressing provisions for all containers, <br />whether single or dual sort, and addressing multi-family <br />recycling as well. <br /> <br />Page 15, Section 5.05, Curbside Single Stream <br />Mr. Pratt clarified that the City anticipates there may be cart <br />providers, and language should say, "The City maintains the <br />right to use its own designated company to provide carts, cart <br />maintenance and repair service." <br /> <br />City Attorney Anderson suggested that due to depreciating the <br />carts, the two items should be differentiated; and another stand <br />alone paragraph be added to encourage bidders to utilize options. <br /> <br />Page 16, Section 5.06, Collection, Curbside Dual Sort <br />Councilmember Schroeder suggested additional qualifications to <br />define how to apply for free walk-up services. <br /> <br />Mr. Pratt reviewed historical problems creating the need for this <br />section to allow only City staff to make that determination. <br /> <br />City Attorney Anderson recommended that the clause <br />referencing Section 4.37 should be moved immediately <br />following the "Free walk-up service.. .." provision both in the <br />curbside dual sort section, and the curbside single stream section. <br /> <br />Typographical correction in line 1 of Curbside Single Stream, <br />first paragraph, delete "by" or "at." <br />
