City Council Regular Meeting - 08/22/05 Minutes - Page 31 City Attorney Anderson recommended leaving the language in to provide monitoring and obligations under a contract, as with other provisions to provide the City additional leverage. Mr. Anderson noted that the specific items were standard language for RFP's and contracts to provide notice to a contractor of City expectations and standards. Further discussion included ownership, maintenance and repair of recycling containers, impacts to cost comparisons, and single- sort or dual-sort provisions. City Attorney Anderson recommended an additional clause at the end of Section 5.05 addressing provisions for all containers, whether single or dual sort, and addressing multi-family recycling as well. Page 15, Section 5.05, Curbside Single Stream Mr. Pratt clarified that the City anticipates there may be cart providers, and language should say, "The City maintains the right to use its own designated company to provide carts, cart maintenance and repair service." City Attorney Anderson suggested that due to depreciating the carts, the two items should be differentiated; and another stand alone paragraph be added to encourage bidders to utilize options. Page 16, Section 5.06, Collection, Curbside Dual Sort Councilmember Schroeder suggested additional qualifications to define how to apply for free walk-up services. Mr. Pratt reviewed historical problems creating the need for this section to allow only City staff to make that determination. City Attorney Anderson recommended that the clause referencing Section 4.37 should be moved immediately following the "Free walk-up service.. .." provision both in the curbside dual sort section, and the curbside single stream section. Typographical correction in line 1 of Curbside Single Stream, first paragraph, delete "by" or "at."
