<br />City Council Regular Meeting - 08/22/05 <br />Minutes - Page 6 <br /> <br />4.b <br /> <br />Approve the Request of Monarch Bus Service, <br />Incorporated, to Install a 4,000 Gallon Above-Ground <br />Fuel Tank at 1743 County Road C (PF 3675) (former <br />Consent Item 3.f) <br />At the request of Mayor Klausing, Community <br />Development Director Dennis Welsch briefly reviewed this <br />request. Mr. Welsch noted that it was a matter of <br />environmental safety to keep the tank above ground and <br />within containment areas with safety barriers. Mr. Welsch <br />further noted that, in the past, above-ground tanks have a <br />much better history of spill and leak protection than <br />underground tanks, and can be removed much easier. <br /> <br />Councilmember Ihlan advised that she had significant <br />questions, and suggested the Council may wish to postpone <br />consideration ofthis request for a future meeting. <br /> <br />Councilmember Ihlan's questions concerned: <br />I) Whether sufficient public notice had been provided <br />related to this request. Mr. Welsch advised that this type of <br />request did not require a public hearing. <br /> <br />2) Whether this request was consistent with the City's <br />Comprehensive Plan and Zoning for the Twin Lakes area, <br />even though temporary, when the City was moving away <br />from tanks in that area. Mr. Welsch advised that the zoning <br />for this area is 1-2, Heavy Industrial District, and since the <br />moratorium expired August 1, 2005, and similar storage <br />has taken place on the site in the past, there was nothing to <br />exclude such a use; and no control over the site except City <br />Council approval or denial based on safety and security <br />rationale. Mr. Welsch noted that the Fire Marshal had <br />reviewed the request and the site, and recommended <br />approval. Councilmember Ihlan referenced a portion of <br />City Ordinance related to above-ground tanks. Mr. Welsch <br />referred Councilmember to a paragraph in the code and <br />staffs interpretation. <br /> <br />3) Councilmember Ihlan questioned what environmental <br />review had been done on the site.
