City Council Regular Meeting - 08/22/05
Minutes - Page 6

4.b

Approve the Request of Monarch Bus Service,
Incorporated, to Install a 4,000 Gallon Above-Ground
Fuel Tank at 1743 County Road C (PF 3675) (former
Consent Item 3.f)
At the request of Mayor Klausing, Community
Development Director Dennis Welsch briefly reviewed this
request. Mr. Welsch noted that it was a matter of
environmental safety to keep the tank above ground and
within containment areas with safety barriers. Mr. Welsch
further noted that, in the past, above-ground tanks have a
much better history of spill and leak protection than
underground tanks, and can be removed much easier.

Councilmember Ihlan advised that she had significant
questions, and suggested the Council may wish to postpone
consideration ofthis request for a future meeting.

Councilmember Ihlan's questions concerned:
I) Whether sufficient public notice had been provided
related to this request. Mr. Welsch advised that this type of
request did not require a public hearing.

2) Whether this request was consistent with the City's
Comprehensive Plan and Zoning for the Twin Lakes area,
even though temporary, when the City was moving away
from tanks in that area. Mr. Welsch advised that the zoning
for this area is 1-2, Heavy Industrial District, and since the
moratorium expired August 1, 2005, and similar storage
has taken place on the site in the past, there was nothing to
exclude such a use; and no control over the site except City
Council approval or denial based on safety and security
rationale. Mr. Welsch noted that the Fire Marshal had
reviewed the request and the site, and recommended
approval. Councilmember Ihlan referenced a portion of
City Ordinance related to above-ground tanks. Mr. Welsch
referred Councilmember to a paragraph in the code and
staffs interpretation.

3) Councilmember Ihlan questioned what environmental
review had been done on the site. Mr. Welsch noted that

Monarch Bus
Service
4,000 Gallon
Above-Ground
Fuel Tank
1743 Co Road C
(PF 3675)
