<br />City Council Study Session - 09/19/05 <br />Minntes - Page 8 <br /> <br />to see compliance through a compassionate, orderly process, <br />working with each individual property owner, with the judge <br />ultimately serving as the unbiased third party. <br /> <br />John Kysylyczyn, 3083 N Victoria Street <br />Mr. Kysylyczyn provided a bench handout entitled, "9/19/05 <br />Roseville City Council meeting," providing his perception of the <br />background; current Council process; current process outcomes <br />and results; putting current process in perspective; considerations <br />for proposed changes; and past Councilmember positions on <br />elected official compensation policies. <br /> <br />Mr. Kysylyczyn noted, for the record, his personal "extensive <br />research" on code compliance issues with other agencies and <br />officials. Mr. Kysylyczyn reviewed the various items of his <br />bench hand out, reviewed a recent South St. Paul code <br />enforcement issue; opining that the court was unable to <br />effectively address local problems; and further opining that the <br />City Council hearing was a better process with staff coming <br />forward to the City Council and receiving full Council support <br />prior to resolution or moving forward in issuing a court citation. <br /> <br />Further discussion included prosecution contract provisions; and <br />the distinction between City involvement in enforcement and <br />judicial role of fact finder and judge's determination as to <br />compliance. <br /> <br />City Attorney Squires noted that the vital point, under either <br />system, was that the decision was made by a neutral party to <br />make findings offact. <br /> <br />Councilmember Schroeder spoke in support of retaining the <br />current procedure, allowing another alternative to prosecution. <br /> <br />Mayor Klausing expressed concern that the current process lent <br />itself to abuse; and suggested 1) elimination; or 2) development <br />of criteria to base Council decision. <br /> <br />Councilmember Kough opined his support of the current system <br />for quick resolution by the Council (i.e., "power-making <br />people"). <br />
