<br />City Council Study Session - 10/17/05 <br />Minutes - Page 10 <br /> <br />Bennett; and Code Enforcement Officer Don Munson provided <br />background; intent; and process for proposed adoption of a <br />Property Maintenance Code and a Licensing and Inspection of <br />Residential Rental Property of I - 4 units; by adoption of new <br />City Code Sections 906 and 907 respectively. <br /> <br />Mr. Welsch reviewed the proposed Property Maintenance Code, <br />providing a Draft of a proposed ordinance and referencing the <br />International Property Maintenance Code (IPMC) as amended to <br />concur with existing City Code and State Building Code. <br /> <br />Discussion included staff's and the HRA's perspective of <br />maintenance problems with single-family housing; outlined the <br />purpose and goals of the proposed code; request of staff for <br />authority of the City to regulate conditions and maintenance of <br />all property and to establish a base line for existing buildings, <br />with new buildings covered by zoning and building code <br />provisions. Mr. Welsch noted that the items proposed were in <br />response to neighborhood meetings and expressed concerns <br />through a series of public meetings held by the HRA to retain <br />property values and enhance street appeal of existing properties, <br />in addition to ensuring safe, sanitary and fit conditions for <br />occupancy and use. <br /> <br />Further discussion included general versus specific maintenance <br />provisions; maintaining building integrity; and Council <br />preference for ordinance adoption. <br /> <br />Staff noted that they would be preparing examples for exterior <br />and interior property maintenance via educational tools for <br />property owners. Staff provided several recent examples of their <br />lack of authority to enforce maintenance to a safe level in several <br />instances. <br /> <br />Council and staff discussion included staff access to premises of <br />non-cooperative property owners and/or landlords; use of <br />administrative warrants and inspection provisions; annual fee <br />approval by City resolution; effective date; and the need to <br />incorporate adoption of the Property Maintenance Code and the <br />Rental Licensing and Inspection Code. <br />
