<br />City Council Regular Meeting -10/24/05 <br />Minntes - Page 22 <br /> <br />Roll Call <br />Ayes: Schroeder and Klausing. <br />Nays: Ihlan; Maschka and Kough. <br />Motion failed. <br /> <br />City Attorney Anderson clarified that the motion to approve had <br />failed; that it was not a denial of the project request and had a <br />different legal effect, that he later clarified for the developer. <br /> <br />Ihlan moved, Maschka seconded, tabling Planning Case 3665 <br />indefinitely. <br /> <br />Roll Call <br />Ayes: Ihlan; Maschka and Kough. <br />Nays: Schroeder and Klausing. <br /> <br />Ihlan moved, Kough seconded, to direct Staff to prepare a <br />moratorium ordinance for Council consideration, with respect to <br />Title 11 of City Code, related to subdivisions, plats, minor <br />subdivisions, platting procedures, preliminary plats and related <br />issues for the purpose of conducting a study reviewing <br />ordinances and policies. <br /> <br />City Planner Paschke sought clarification on several points of the <br />ordinance: <br />1) Corrected reference to Title 11, not Chapter 11; <br />2) Under the motion language, staffs review would do <br />nothing to address lot size, which was specified in zoning <br />code; nor was the intent to review the subdivision <br />ordinance related to storm sewer drainage, etc. <br />3) Asked specifically what the moratorium affected: platting <br />in general, which would curtail the majority of the City's <br />development; or to stop land from being divided. <br />Mr. Paschke sought details for drafting of the ordinance to avoid <br />confusion. <br /> <br />Discussion ensued regarding timing of the moratorium; drafting <br />of the ordinance language versus adopting the moratorium; <br />impact to Preliminary Plats already in process; legislative <br />changes to moratorium provisions; and Council intent of the <br />motion. <br />
