Mr. Neprash
sited one example of excavating to replace catch basins and
the watershed requirements for a simple mill and overlay
project on city streets.

2.

Discuss Property Acquisition at Twin Lakes
Community Development Director Dennis Welsch introduced
Mr. Rod Krass, attorney with Krass Monroe group; and the
City's Attorney in this case. Mr. Welsch noted that the City had
reached a point in the Twin Lakes situation where additional
information was needed by the City Council regarding the
Eminent Domain process.

Mr. Krass reviewed detailed information via Memorandum and
verbally related to the condemnation process utilized by
municipalities under Minnesota state law.

Mr. Krass reviewed recent conversations with the developer; the
developer's responsibilities; due diligence of staff in reviewing
an extensive packet of materials for each parcel and the
developer's acquisition efforts to-date for each specific property,
including appraisals and written offers to those current property
owners.

Mr. Krass noted that due to the public nature of City Council
meetings, he couldn't disclose appraisal amounts, but noted that
staff had collectively determined that they were not convinced
that the redeveloper had done everything possible to pursue
acquisition before their request for Eminent Domain.

Mr. Krass reviewed the legitimate concerns of the developer
related to environmental remediation and implications to the
property value due to potential remediation. Mr. Krass noted
that the existing property owners were insistent that there were
no environmental concerns to be addressed.

Mr. Krass advised that staff and the City's Attorney (Krass
Monroe) had recommended that the developer return to the

Property
Acquisition at
Twin Lakes
