<br />City Council Study Session -11/21/05 <br />Minutes - Page 4 <br /> <br />rules were being discussed at the League of Minnesota <br />Cities (LMC) level; and suggested there may be coming a <br />point where the collective cities alert the Watershed <br />District of the seriousness of their concerns. Mr. Neprash <br />sited one example of excavating to replace catch basins and <br />the watershed requirements for a simple mill and overlay <br />project on city streets. <br /> <br />2. <br /> <br />Discuss Property Acquisition at Twin Lakes <br />Community Development Director Dennis Welsch introduced <br />Mr. Rod Krass, attorney with Krass Monroe group; and the <br />City's Attorney in this case. Mr. Welsch noted that the City had <br />reached a point in the Twin Lakes situation where additional <br />information was needed by the City Council regarding the <br />Eminent Domain process. <br /> <br />Mr. Krass reviewed detailed information via Memorandum and <br />verbally related to the condemnation process utilized by <br />municipalities under Minnesota state law. <br /> <br />Mr. Krass reviewed recent conversations with the developer; the <br />developer's responsibilities; due diligence of staff in reviewing <br />an extensive packet of materials for each parcel and the <br />developer's acquisition efforts to-date for each specific property, <br />including appraisals and written offers to those current property <br />owners. <br /> <br />Mr. Krass noted that due to the public nature of City Council <br />meetings, he couldn't disclose appraisal amounts, but noted that <br />staff had collectively determined that they were not convinced <br />that the redeveloper had done everything possible to pursue <br />acquisition before their request for Eminent Domain. <br /> <br />Mr. Krass reviewed the legitimate concerns of the developer <br />related to environmental remediation and implications to the <br />property value due to potential remediation. Mr. Krass noted <br />that the existing property owners were insistent that there were <br />no environmental concerns to be addressed. <br /> <br />Mr. Krass advised that staff and the City's Attorney (Krass <br />Monroe) had recommended that the developer return to the <br /> <br />Property <br />Acquisition at <br />Twin Lakes <br />
