<br />NOW THEREFORE BE IT RESOLVED, by the Roseville City Council, to deny a <br />2-1/2 foot VARIANCE to Section 703.04B9 (Driveways on Private Property) and a 70 <br />foot VARIANCE to Section 1004.015 (Dwelling Dimensions - Lot Width) of the <br />Roseville City Code for property at 2808 Lakeview A venue, based on the following <br />findings of fact: <br /> <br />1. Minn. Stat. 9 462.357 provides that a variance should only be granted when it has <br />been demonstrated that the standards for issuance of a variance have been met; the <br />applicant has not demonstrated the variance standards have been met. <br /> <br />2. A variance should not be granted if it will alter the essential character of the area. <br />The Council finds the character of this area to be a lower density, quiet <br />neighborhood, and also finds that the creation of a flag to allow construction of a <br />second home would: <br /> <br />a. Negatively impact the privacy of surrounding properties; and <br />b. Increase traffic <br /> <br />3. A variance should not be granted where the basis for the variance request is <br />economic. The Council finds that the Builder/Applicant's request is economic in <br />nature-he wishes to create two lots out of one lot. Ifhe wishes to reside on the <br />property, alternatives exist to the creation of a flag, namely, demolition of the <br />existing structure, and reorientation of a new structure on the lot. <br /> <br />4. Grant of the requested variances would negatively impact an adjacent property by <br />allowing construction of a driveway to within 2.5 feet of the property line. This <br />reduced separation would increase the effects of auto-related activity on the <br />adjacent property. <br /> <br />The motion for the adoption of the foregoing resolution was duly seconded by <br />Council Member Kough and upon vote being taken thereon, the following voted in favor: <br />Ihlan, Kough, Maschka, and Schroeder <br /> <br />and the following voted against: Klausing. <br /> <br />WHEREUPON said resolution was declared duly passed and adopted. <br /> <br />2 <br />
