<br />EXTRACT OF MINUTES OF MEETING OF THE <br />CITY COUNCIL OF THE CITY OF ROSEVILLE <br /> <br />Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of <br />Roseville, County of Ramsey, Minnesota, was held on the 28th day of November, 2005, at 6:00 <br />p.m. <br /> <br />The following members were present: Mayor Klausing, and Council Members Ihlan and <br />Kough and the following were absent: Council Members Schroeder and Maschka. <br /> <br />Council Member Kough introduced the following resolution and moved its adoption: <br /> <br />RESOLUTION NO. 10355 <br /> <br />A RESOLUTION APPROVING A CONDITIONAL USE PERMIT FOR TERRANCE <br />FENNE, 910 HIGHWAY 36 IN ACCORDANCE WITH SECTION 1013 OF THE <br />ROSEVILLE CITY CODE ALLOWING A 1,008 SQ. FT. DETACHED ACCESSORY <br />STRUCTURE IN THE REAR YARD (PF3691) <br /> <br />WHEREAS, Terrance Fenne has requested a CONDITIONAL USE PERMIT in <br />accordance with Section 1013 of the Roseville City Code to allow the construction of a 1,008 sq. <br />ft. detached accessory structure in his rear yard; and <br /> <br />WHEREAS, the Fenne property (910 Highway 36) is legally described as: <br /> <br />Auditor's Subdivision No. 64, Saint Paul, Minnesota - the East 100 feet of the following <br />North 86 - 48811000 feet of Lot 3 and part south of Highway 36 <br />PIN: 11-29-23-34-0012 <br /> <br />WHEREAS, Section 1004.01A4 (Requirements for Increased Size) requires a detached <br />accessory structure between 864 sq. ft. and 1,008 sq. ft. to receive a conditional use permit and <br />more importantly the proposal must meet the 6 CONDITIONLAL USE PERMIT criteria <br />stipulated in the City Code; and <br /> <br />WHEREAS, Mr. Fenne seeks approval to construct a new 1,008 sq. ft. detached <br />accessory structure in his rear yard, for which an existing 192 sq. ft ( approximate) shed would be <br />removed and the existing attached garage (396 sq. ft.) would be converted to living area.; and <br /> <br />WHEREAS, Mr. Fenne can obtain, without City Council approval, a building permit for <br />an 864 sq. ft. detached accessory structure; and <br /> <br />WHEREAS, the CONDITIONAL USE PERMIT proposal seeks to increase this size by <br />144 sq. ft.; and <br /> <br />WHEREAS, the Planning Commission held a public hearing on November 2, 2005 <br />concluding that the proposed improvements are consistent with the criteria of Section 1013 of the <br />Roseville City Code; <br /> <br />1 <br />
