<br />WHEREAS, the Planning Commission voted (7-0) to recommend approval of the <br />request, subject to 8 conditions. <br /> <br />NOW THEREFORE BE IT RESOLVED, by the Roseville City Council, to grant <br />a CONDITIONAL USE PERMIT to Terrance Fenne, 910 Highway 36, based on the findings of <br />Section 5 of the project report dated November 28,2005 and subject to the following conditions: <br /> <br />1. The total impervious coverage on the parcel after construction of the 1,008 sq. ft. <br />detached accessory structure (garage) and driveway improvement and existing <br />house improvements shall not exceed 5,489 sq. ft or 30% ofthe overall 18,295 <br />sq.ft. lot size. <br /> <br />2. The detached accessory structure (garage) shall be set back a minimum of 5 feet <br />from the interior side yard (east/west) property line and a minimum of 5 feet from <br />the rear yard (south) property line. <br /> <br />3. No other detached accessory structure or garden shed shall be permitted on the <br />parcel. The existing shed located in the rear yard (south) must be removed from <br />the premises. <br /> <br />4. The size of the detached accessory structure shall not exceed 1,008 sq. ft.; its <br />height shall not exceed an exterior wall height of 9 feet and an overall height of 15 <br />feet to the mid-point of the roof truss (measured from grade). <br /> <br />5. The exterior color, design, and/or material of the detached accessory structure <br />shall be similar to the principal structure (Section 1004.01A12). <br /> <br />6. Drainage and roof gutters shall be installed to direct runoff away from the <br />adjoining (south/east/west) property. <br /> <br />7. The applicant must receive a building permit to convert the existing attached <br />garage into living space prior to the issuance of a Certificate of Occupancy for the <br />detached accessory structure. <br /> <br />8. The CONDITIONAL USE PERMIT shall expire within six months after the <br />approval date (May 21, 2006) unless that applicant has been granted a building <br />permit. <br /> <br />The motion for the adoption of the foregoing resolution was duly seconded by Council <br />Member Klausing and upon vote being taken thereon, the following voted in favor: Kough & <br />Klausing <br /> <br />and the following voted against: Ihlan <br /> <br />WHEREUPON said resolution was declared duly passed and adopted. <br /> <br />2 <br />
