<br />City Council Regular Meeting - 11/28/05 <br />Miuutes - Page 24 <br /> <br />Larson suggested that additional information be provided for <br />documentation of hard evidence regarding multiple complaints <br />on specific properties and proportionately what was rental and <br />what was owner-occupied. Ms. Larson opined that there was not <br />sufficient information for the Council to make an intelligent <br />decision at this time; suggested modifications to assist with <br />property maintenance concerns; but strongly opposed the <br />Council's "crossing the line" related to rental properties. <br /> <br />John Kysylyczyn, 3083 N Victoria Street <br />Mr. Kysylyczyn provided his personal history and background; <br />and his staunch support of property owner rights. Mr. <br />Kysylyczyn suggested that the issues be kept distinct: that of <br />rental licensing and the property maintenance code. <br /> <br />Related to the rental issue, Mr. Kysylyczyn addressed the public <br />information gathering for rentals versus private ownership; <br />benefit to the landlord from the fee; whether the City would <br />stand behind their inspection report in court; and the need for <br />provision of a credit of some type for the landlord removing <br />problem tenants and resolution of problem situations. Mr. <br />Kysylyczyn reviewed specific sections and definitions of the <br />proposed code. <br /> <br />Related to the property maintenance code, Mr. Kysylyczyn noted <br />that this proposed ordinance was applicable to every homeowner <br />in the City, not just rental properties; and also addressed specific <br />sections and definitions of the proposed code and his <br />recommendations for revision. Mr. Kysylyczyn cautioned that <br />elected City Council should not delegate their authority (Section <br />106.3) to code officials or any staff. Mr. Kysylyczyn concluded <br />by admonishing that promissory statements should be made in <br />writing, not verbally. <br /> <br />Ann Berry, 1059 Woodhill Drive <br />Ms. Berry, from her perspective as a long-time homeowner and <br />service on the City's Planning Commission recognized that an <br />entirely different group of residents was at tonight's meeting <br />than those attending the BRA neighborhood meetings. Ms. <br />Berry noted, from her past experience on the Planning <br />Commission, the City was recipient of numerous and significant <br />
