<br />City Council Regular Meeting - 11128/05 <br />Minutes - Page 34 <br /> <br />and urged the Council to not do so; and urged even further <br />restrictions than those proposed by Councilmember Ihlan. <br /> <br />Mayor Klausing refocused the discussion to Councilmember <br />Ihlan's proposed policies; not one of re-debating Twin Lakes <br />Issues. <br /> <br />Rod Ruda, 946 Lydia Drive <br />Mr. Ruda opined that the entire idea of Eminent Domain scared <br />him as a private citizen; and urged care by the City Council of <br />local policies and guidelines, making decisions on an overall <br />basis, after pending state legislation is finalized and how the <br />City's future planning fit that picture. Mr. Ruda further opined <br />that there were so many ways Eminent Domain could be <br />misused, the Council needed to establish a policy, not make <br />decisions on a case by case basis. <br /> <br />Donald Sem, 2231 W Roselawn <br />Mr. Sem opined that Eminent Domain was one of the most <br />confusing and scary things he was aware of, and discouraged any <br />use unless for a specific public purpose of school; further urging <br />the City Council not to reward developers or "make them <br />richer. " <br /> <br />John Kysylyczyn, 3083 N Victoria Street <br />Mr. Kysylyczyn opined that some ideas suggested in <br />Councilmember Ihlan's memo may already be covered by state <br />statute; encouraged a Public Hearing on a parcel by parcel basis; <br />expressed concern regarding comments he'd heard regarding use <br />of Eminent Domain on cemetery and/or church property and <br />spoke in opposition to such use of Eminent Domain. Mr. <br />Kysylyczyn referenced past Eminent Domain authority given to <br />City employees and cautioned against the City Council <br />delegating such authority to staff, rather than elected officials. <br />Mr. Kysylyczyn further opined that it was not good public policy <br />to take school district property by Eminent Domain, as the <br />school board was an independent elected board. <br /> <br />In a related note, Mr. Kysylyczyn reminded Councilmembers <br />that a previously-adopted policy stated that the City Council was <br />to meet with their legislative delegation annual to provide City <br />
