<br />City Council Regular Meeting -11/28/05 <br />Minutes - Page 33 <br /> <br />Roll Call [9.1] <br />Ayes: Kough and Klausing. <br />Nays: Ihlan. <br />Motion adopted. <br /> <br />11. <br /> <br />Proposed Policies on Use of Eminent Domain <br />Councilmember Ihlan presented a memorandum to the City <br />Council dated November 22,2005, with several policy proposals <br />she had developed for the Council's consideration in using <br />eminent domain for development and/or redevelopment. <br />Councilmember Ihlan sought public comment on her proposed <br />policies. Councilmember Ihlan presented three proposals: <br />l) A broad policy proposal stating that "Eminent Domain <br />shall not be used for private commercial development or <br />redevelopment;" <br />2) A proposed policy stating that "Eminent Domain shall not <br />be used for retail developments including stand-alone <br />stores of 50,000 square feet or more, or for "shopping <br />centers" as defined by City zoning code; in an effort to <br />avoid additional saturation of retailers in the City; <br />3) A more complicated proposal with general statements that <br />· "Eminent Domain shall not be used for private <br />commercial development or redevelopment, <br />unless..." certain conditions were met, and as <br />outlined in more detail in Councilmember Ihlan's <br />memo; OR <br />· That "Eminent Domain shall not be used for <br />housing development or redevelopment unless..." <br />certain conditions were met, and as outlined in more <br />detail in Councilmember Ihlan's memo. <br /> <br />Richard Houck <br />Mr. Houck stated that he was adamantly opposed to the use of <br />Eminent Domain for development; and opined that the Council <br />needed to understand the amount of opposition and political <br />repercussions within the community should the majority of the <br />City Council choose to use it. Mr. Houck referenced recent <br />Supreme Court action and continuing public debate of the Kelo <br />case. Mr. Houck opined that if the City Council used Eminent <br />Domain for any Twin Lakes related development, they would be <br />acting in opposition to the wishes of the citizens of Roseville; <br /> <br />Proposed Policies <br />on Use of Eminent <br />Domain <br />
