<br />City Council Regular Meeting - 05/10/04 <br />Minutes - Page 22 <br /> <br />Mr. Paschke noted that each parcel would meet or exceed all (PF 3556) <br />City lot size requirements. Mr. Paschke noted that, at the April <br />7, 2004 Planning Commission meeting, a public hearing was <br />held with resulting unanimous Planning Commission <br />recommendation for denial of the request. Mr. Paschke that the <br />administrative request currently before the Council had been <br />revised to meet City Code requirements; and staff was thus <br />recommending approval. <br /> <br />Dan Wall, Attorney representing applicant Vernon <br />Albertson <br />Mr. Wall reviewed the nature of the request. Mr. Wall spoke to <br />several concerns in staffs list of conditions (Item. 3.8) restricting <br />variance or setback permits for future development of a principal <br />structure and/or accessory building on Parcel "B;" requesting its <br />removal to prevent adverse impacts on sale of the property. Mr. <br />Wall also expressed a preference that Items 3.9 and 3.10 be <br />removed as conditions, but was open to negotiation on those <br />points. <br /> <br />At this time, Mayor Klausing opened the meeting to public <br />comment related to this item. <br /> <br />Craig Churchward, 3093 N Asbury Street (immediately <br />south of property) <br />Mr. Churchward questioned procedure related to materials made <br />available for City Council review. <br /> <br />Mr. Paschke responded, at Mayor Klausing's direction, that the <br />information referenced by Mr. Churchward was related to the <br />previous request for a minor subdivision, and would not be <br />appropriate to forward that information with this new request. <br /> <br />Mr. Churchward expressed concern regarding comments from <br />Mr. Wall about the lack of public opposition evidenced by the <br />number of people in the audience representing was misleading, <br />opining that residents had been at the Planning Commission <br />meeting, with the understanding that the Public Hearing was <br />appropriate for their involvement. Mr. Churchward provided <br />two bench handouts consisting of an April 7, 2004, and a May <br />10, 2004, letter from him to Mr. Paschke relating his comments <br />
