<br />1 <br /> <br />03/09/04 <br /> <br />[REVISOR] XX/KJ <br /> <br />04-5779 <br /> <br />(2) a provision to inform the customer of the posting <br /> <br />3 (3) the requirement that the customer notify neighbors <br /> <br />requirements set forth in section 145.944; and <br /> <br />4 before application of pesticides so that neighbors may take <br /> <br />6 <br /> <br />5 precautions to avoid pesticide exposure. <br /> <br />Subd. 4. <br /> <br />[DIRECT NOTIFICATION.] "Direct notification" <br /> <br />7 includes: <br /> <br />8 (1) posting of the premises to which a pesticide is <br /> <br />9 applied; and <br /> <br />10 (2) direct personal notice to affected persons in person or <br />11 by mail, electronic mail, or telephone. <br /> <br />12 <br /> <br />Subd. 5. [PESTICIDE.] "Pesticide" means a substance or <br /> <br />13 mixture of substances intended to prevent, destroy, repel, or <br /> <br />14 est or a substance or mixture of substances intended <br /> <br />15 for use as a plant regulator, defoliant, or desiccant. The <br /> <br />16 following are not pesticides: <br /> <br />17 (1) antimicrobial pesticides and antimicrobial products as <br />18 defined under United States Code, title 7, sections 136, <br /> <br />20 <br /> <br />21 <br /> <br />22 <br /> <br />23 <br /> <br />24 <br /> <br />25 <br /> <br />26 <br /> <br />27 <br /> <br />28 <br /> <br />29 <br /> <br />30 <br /> <br />31 <br /> <br />32 <br /> <br />33 <br /> <br />34 <br /> <br />36 <br /> <br />I <br />I <br />I <br />i <br />Cod~ <br /> <br />paragraph (mID), and 136q, paragraph (h), clause (2); <br />(2) a pesticide classified by the United States <br /> <br />Environmental Protection Agency as an exempt material under <br /> <br />of Federal Regulations, title 40, part 152.25; <br /> <br />(3) a pesticide that the United States Environmental <br /> <br />Protection Agency (EPA) has determined satisfies the EPA's <br /> <br />reduced risk criteria, including a biopesticide; <br /> <br />(4) boric acid and disodium octaborate tetrahydrate; or <br /> <br />(5) horticultural soap and oils that do not contain <br />synthetic pesticides or synergists. <br /> <br />Subd. 6. <br /> <br />[PESTICIDE EXPOSURE.] (a) "Pesticide exposure" <br /> <br />I <br />I <br /> <br />(1) the direct exposure of a person to the application of ~ <br /> <br />means: <br /> <br />pesticide; <br /> <br />(2) exposure of a person by applications to property <br />abutting the premises where a pesticide is intended to be <br /> <br />applied; or <br />(3) application of a pesticide within 150 feet of a <br /> <br />Section 2 <br /> <br />2 <br />
