<br />03/09/04 <br /> <br />[REVISOR] XX/KJ <br /> <br />04-5779 <br /> <br />1 dwelling, multiple dwelling, public building, or public park. <br />(b) The following pesticide applications do not create <br />3 pesticide exposure: <br />4 (1) the use of an aerosol product with a directed spray, in <br />5 containers of 18 fluid ounces or less, when used to protect <br />6 individuals from an imminent threat from stinging and biting <br />7 insects, including venomous spiders, bees, wasps, and hornets. <br />8 This clause does not exempt from notification the use of a <br />9 fogger or aerosol product that discharges to a wide area; <br />10 (2) the use of nonvolatile insect or rodent bait in a <br />11 tamper-resistant container; <br />12 (3) the application of a granular pesticide, where granular <br />13 pesticide means any ground-applied solid pesticide that is not a <br />14 dust or powder; <br />15 (4) the application of a pesticide by direct injection into <br />16 a plant or the ground; <br />17 (5) the spot application of a pesticide, where spot <br />18 application means the application of pesticide in a manually <br />pressurized or nonpressurized container of 32 fluid ounces or <br />20 less to an area of ground less than nine square feet; <br />21 (6) the application of a pesticide to the ground or turf of <br />22 any cemetery; or <br />23 (7) any emergency application of a pesticide when necessary <br />24 to protect against imminent th.reat to human health, provided, <br />25 however, that before emergency application, the person making <br />26 the application makes a good faith effort to supply the written <br />27 notice required under section 145.943. <br />28 Subd. 7. [WRITTEN NOTICE.] "Written notice" means a notice <br />29 in writing containing at least the following: <br />30 (1) the address of the premises or other description of the <br />31 location where a pesticide is to be applied; <br />32 (2) if the application is to be done by a certified <br />33 applicator, the name, telephone number, and certified applicator <br />34 number of the person applying the pesticide; <br />, (3) the specific date of each pesticide application and two <br />36 alternative dates to the proposed date of application when, if <br /> <br />Section 2 <br /> <br />3 <br />
