<br />03/09/04 <br /> <br />[REVISOR] XX/KJ <br /> <br />04-5779 <br /> <br />1 supply direct personal notice as required under this subdivision <br /> <br />including, but not limited to, mailing or leaving with a <br /> <br />3 responsible adult or in a conspicuous location on the abutting <br />4 property; <br /> <br />5 (2) the manner in which the owner or owner's agent of <br /> <br />6 multiple family dwellings must supply written notice to the <br />7 occupants of multiple family dwellings; and <br /> <br />8 (3) for all other premises, the manner in which the owner, <br /> <br />9 owner's agent, or other person in a position of authority must <br /> <br />10 supply written notice. <br />11 (c) The rules shall specify a manner in which persons <br /> <br />12 providing pesticide applications may provide an option to <br /> <br /> <br />13 occupants of dwellings to decline further notices. <br /> <br />14 Sec. 6. [145.945] [EMERGENCY APPLICATIONS.] <br /> <br />+ <br />15 (a) Upon making an emergency application, the person making <br /> <br /> <br />16 the application must notify the commissioner of health, using a <br /> <br /> <br />17 form prescribed by the commissioner that includes: <br /> <br />18 <br /> <br />(1) the name of the person making application; <br /> <br />~ (2) the pesticide business registration number or the <br /> <br /> <br />20 certified applicator number of the person applying the <br /> <br /> <br />21 pesticide; <br /> <br />22 (3) the location of the application; <br /> <br /> <br />23 (4) the date of application; <br /> <br /> <br />24 (5) the product name and united States Environmental <br /> <br /> <br />25 Protection Agency registration number of the pesticide applied; <br /> <br />26 and <br /> <br />27 (6) the reason for application. <br /> <br />28 (b) The commissioner shall review any emergency form <br /> <br /> <br />29 submitted under this section to ensure that the circumstance <br /> <br />30 warranted the emergency application. The forms shall be kept on <br /> <br /> <br />31 file at the Department of Health for three years from the date <br /> <br /> <br />32 of application and are public data. <br /> <br />33 Sec. 7. [145.946] [ADMINISTRATIVE PENALTIES.] <br />34 Subdivision 1. [LOCAL ORDINANCE.] A city that adopts a <br /> <br />local ordinance under sections 145.941 to 145.947, in addition <br /> <br />36 to any authority otherwise conferred under sections 145.941 to <br /> <br />Section 7 <br /> <br />6 <br />
