<br />03/09/04 <br /> <br />[REVISOR] XX/KJ <br /> <br />04-5779 <br /> <br />1 (c) At least 48 hours before, but not more than seven days <br />before, an application of a pesticide, the person or entity <br />3 making application must supply written notice to: <br />4 (1) occupants of all dwellings on abutting property with a <br />5 boundary that is within 150 feet of the site of application; and <br />6 (2) owners, owners' agents, or other persons in a position <br />7 of authority for all other types of premises that are on <br />8 abutting property with a boundary that is within 150 feet of the <br />9 site of the application. <br />10 Subd. 2. [PENALTY FOR VIOLATION.] Any person who <br />11 intentionally violates an ordinance or rule adopted under <br />12 sections 145.941 to 145.947 is subject to imprisonment for not <br />13 more than 90 days or to payment of a fine of not more than <br />14 $1,000, or both. <br />15 Sec. 5. [145.944] [STANDARD FOR DIRECT NOTIFICATION.] <br />16 subdivision 1. [APPLICABILITY.] In cities where a neighbor <br />17 notification ordinance has been adopted under section 145.943, <br />18 the direct notification under this section is required. <br />J Subd. 2. [POSTING.] (a) Markers must be placed within or <br />20 along the perimeter of the area where pesticides will be <br />21 applied. Markers must be placed so as to be clearly visible to <br />22 persons immediately outside the perimeter of the property. <br />23 Markers on the perimeter of a property must be placed no more <br />24 than 100 feet apart. The markers must be posted at least 12 <br />25 inches above the ground and must be at least four inches by five <br />26 inches in size. <br />27 (b) The markers required under this subdivision must be in <br />28 place on the day the pesticide is applied and must instruct <br />29 persons not to enter the property and not to remove the signs <br />30 for a period of at least 24 hours. The instruction must be <br />31 printed in bold letters at least three-eighths of an inch in <br />32 height. <br />33 Subd. 3.
