<br />City Council Regular Meeting - 12/19/05 <br />DRAFT Minutes - Page 24 <br /> <br />Mr. Krass advised that the condemnation process by law, <br />includes that consideration be given to what type of <br />contamination and what it will cost to clean up, and that the <br />market value, less clean up costs, is then determined. Mr. Krass <br />noted that this was in keeping with Council direction and <br />preference for polluters to shoulder the responsibility of <br />contamination on their property, rather than the City being <br />required to do so. <br /> <br />Public Comment <br />Kris Krengel, 1681 Ridgewood Lane N <br />Mr. Krengel noted his experience with commercial real estate <br />and eminent domain issues in selling commercial real estate; and <br />his involvement in several major projects. Mr. Krengel <br />concurred with Councilmember Kough's interpretation that <br />eminent domain forced property owners into selling against their <br />will. Mr. Krengel expressed concern that businesses forced to <br />relocate often didn't remain viable for the long-term. Mr. <br />Krengel questioned the need for and expertise of City appraisers, <br />and why the County appraisers weren't used. Mr. Krengel sited <br />several cases where developers had obtained property through <br />eminent domain and several years later had sold the property at a <br />substantial profit. <br /> <br />Al Sands, 2612 Aldine <br />Mr. Sands expressed his concern regarding this process; <br />questioned the minimal facts as presented by Mr. Krass; and <br />suggested that at least one Councilmember have an opportunity <br />to review the data referenced by Mr. Krass. Mr. Sands <br />questioned language in the resolution under Section 3.01, last <br />sentence, and why it was necessary for inclusion. Mr. Sands <br />further questioned parcel 8-3 on the map provided showing Twin <br />Lakes ownership and acquisition, dated December 19,2005. Mr. <br />Sands was concerned that this city-owned property not be <br />misrepresented as development-owned property. <br /> <br />Community Development Director Welsch advised that the <br />property in question (8-3) was city-owned property, and was not <br />part of the development acquisition. <br /> <br />Dick Houck, 1133 Roselawn Avenue <br />
