City Council Regular Meeting - 12/19/05 DRAFT Minutes - Page 25 Mr. Houck opined that he felt deceived by the City Council that another Public Hearing was not going to be held regarding eminent domain. Mr. Houck further opined that the City was using eminent domain against overwhelming community and country opposition; and future legislation would clarify the law in every state, including MN. Tim Callahan, 3062 Shorewood Lane Mr. Callahan interpreted tonight's discussion that the redeveloper had made a first offer, rather than continuing negotiations without the threat of eminent domain. Mr. Callahan opined that the timing of the request for use of eminent domain was premature; that there was no public user for the project; expressed concern regarding pending litigation; and further opined that property owners would be assessed for pollution clean up above and beyond that required, since the properties were proposed for residential use. Mr. Callahan opined that Roseville citizens were already paying through tax increment financing; and that it was time for the citizens to look at removal of those Councilmembers voting for approval of eminent domain. John Kysylyczyn, 3083 N Victoria Street Mr. Kysylyczyn opined that the Councilmember Ihlan was accurate in her assessment that the issue was before the Council at tonight's meeting to ensure passage on a 3/2 vote. Mr. Kysylyczyn also addressed his perception of "flip flopping" by Mayor Klausing on his vote related to this project. Kevin Olson, 2465 N Oxford Mr. Olson expressed his opposition to eminent domain; questioning how much it would cost the City taxpayer for clean up of contaminated property. Mayor Klausing closed the meeting for public comment regarding this issue at 9:15 p.m. Mayor Klausing and Mr. Krass responded to those questions asked by the public tonight; and those that had previously been answered during tonight's presentation and discussion.
