<br />City Council Study Session - 01/23/06 <br />Minutes - Page 7 <br /> <br />residents. Rep. Greiling noted that, in her experience, group <br />home operators had expressed a preference for enforcement <br />of local ordinance to keep the entire industry from getting a <br />bad reputation from a few violators. <br /> <br />Mr. Welsch noted the lack of clarity for enforcement of the <br />City's own ordinance related to R-1 Zoning. Mr. Welsh <br />suggested that the Council may wish staff to prepare a policy <br />statement or amendment to the City's Ordinance, R-1 <br />section, stating that group homes had to adhere to all R-1 <br />zoning, as did other single-family homes. <br /> <br />Mayor Klausing sought City Attorney Scott Anderson's <br />opinion on equality issues and impacts of additional <br />language clarifying the ordinance. <br /> <br />City Attorney Anderson concurred with staff s additional <br />language recommendation to further clarify that code would <br />be enforced unilaterally. <br /> <br />Councilmember Pust cautioned consistency and equality in <br />enforcing single-family as well as group homes; and <br />questioned how student housing in single-family residences <br />was being addressed, and whether the City was out of <br />compliance with it's own ordinance; and pending adoption of <br />the International Property Maintenance Code (IPMC). <br /> <br />Councilmember Kough questioned occupancy requirements <br />for group homes. <br /> <br />Discussion included minimum amount of square footage in <br />single- family homes versus group homes; traditional resident <br />occupancy; building code application and uniformity; group <br />home residents, as well as additional staffing, meeting space <br />and participants, and separation of living quarters, and <br />perceptions of a "duplex" in a single-family zoning district. <br /> <br />Further discussion included other applications (i.e., mother- <br />in-law apartments); and consistent application, clarification <br />and enforcement of ordinance and statute. <br />
