<br />City Council Study Session - 01/23/06 <br />Minutes - Page 9 <br /> <br />variances; and need to provide driveways for wheelchair <br />accommodation as addressed by Statute. <br /> <br />Mayor Klausing directed staff to provide the City Council <br />with additional infonnation, whether or not the City Council <br />eventually followed up with additional code language <br />clarification, on the following issues: <br />1) parking enforcement; <br />2) whether to have clarification in the City ordinance; <br />points of tension and what can't be enforced under <br />State Statute; and <br />3) issues that are not currently addressed in City <br />ordinance (i.e., parking, noise) but that should be <br />addressed. <br /> <br />Councilmember Maschka noted the complications between <br />group homes and home businesses; whether a group home <br />was being run as a business and meeting place for staff. <br /> <br />Mr. Welsch noted that some occupants required 2-3 <br />caregivers each living in the unit and whether it was <br />perceived by inspectors as a group home or a management <br />uni 1. <br /> <br />City Attorney Anderson noted that the current referenced <br />legal opinion provided by his office didn't address that <br />specific issue; but whether a unit had been converted into <br />more than one living unit may need to be addressed. <br /> <br />Mr. Welsch also identified whether a facility was in actuality <br />a group home, or a central storage and business unit for a <br />number of other group homes in the area. <br /> <br />City Manager Beets noted that staff was hearing Council <br />direction as their being in favor of quality, affordable <br />housing for residents of group homes to meet their needs <br />while balancing the interests and needs of neighboring <br />property owners. Mr. Beets opined that, when writing and <br />enforcing ordinances, staff would not be able to solve all of <br />the issues, but advised that staff would look more closely at <br />its ordinances; and whether or not there proved a need to <br />
