<br />City Council Regular Meeting - 06/J 4/04 <br />Minutes - Page 22 <br /> <br />the neighborhood; and 4) piecemeal planning creating poor <br />traffic circulation and disrupting the pattern of the neighborhood, <br />specifically noting the driveway on the narrow lot and its access <br />on Ridgewood Road. Councilmember Ihlan concluded that she <br />was concerned about the unified scheme of community interests. <br /> <br />Further discussion ensued related to purpose and jurisdiction; <br />initial development; and actual standards upon which to base <br />decisions; the interpretation of setbacks; building design versus <br />lot design; and pre-existing setbacks. <br /> <br />Councilmember Maschka noted that the Council was required to <br />uphold the oath of the land even when the outcomes don't <br />represent individual choice. Councilmember Maschka noted that <br />the City Council needed to review this ordinance and look at <br />changing their policy in the future, but for now it needed to apply <br />the standards addressed in the ordinance. <br /> <br />Councilmember Kough noted that he would be continuing to <br />vote in support of the request, as based on his previous vote of <br />support. <br /> <br />Further discussion ensued among Councilmembers and City <br />Attorney Anderson related to Condition 3.8 and its inclusion in <br />tonight's action, or whether it would be more appropriate in <br />future variance requests. <br /> <br />Maschka moved, Kough seconded, approval of the request by <br />Vernon Albertson for a two lot minor subdivision of property <br />located at 3103 Asbury Avenue, subject to the findings and <br />conditions listed in Section 3.1 through 3.7, Section 3.9, and <br />Section 3.11; excluding staff recommended conditions in <br />Sections 3.8 and 3.10 of the Report for Council Action dated <br />May 10, 2004. <br />Roll Call <br />Ayes: Schroeder, Maschka, Kough and Klausing. <br />Nays: Ihlan. <br /> <br />Schroeder moved, Maschka seconded directing staff to evaluate <br />the eighty- five foot (85') setback requirement; provide <br />comparisons with other cities; and bring the information back to <br />
