City Council Regular Meeting - 08/09/04 <br />Minutes -Page 23 <br />Klausing moved, Schroeder seconded, consideration of the <br />City Council for the use of Eminent Domain if necessary to <br />acquire property for the Twin Lakes Redevelopment <br />Project. <br />Ihlan moved, Kough seconded, tabling action on this matter <br />pending a more detailed public policy Council discussion at <br />a future meeting. <br />Roll Call <br />Ayes: Ihlan, Kough and Maschka. <br />Nays: Schroeder and Klausing. <br />Ihlan moved, to schedule a Public Hearing at either a <br />Regular or Special City Council Meeting, prior to <br />September 30, 2004, for the purpose of considering public <br />financing to the proposed Twin Lakes Redevelopment <br />project; and further directed staff to notify all taxpayers of <br />said meeting in the most cost-effective, legally accepted <br />manner available. <br />Discussion ensued related to the form of legal public notice <br />and requirements under State Statute and City Code. <br />City Attorney Anderson opined that the legal notification <br />requirements would be based on Open Meeting Law for <br />receiving and presenting information, rather than financing, <br />since the City Council was not approving any financing <br />plan at the proposed meeting. <br />Mr. Casserly noted that tonight's prior Council actions <br />would provide guidance and direction to the developer and <br />consultants, as well as staff, to provide more specific <br />information to the public prior to the end of September. <br />Mayor Klausing recommended if, rather than taking action <br />on the proposed motion, the Council would allow the Chair <br />discretion, after more specific discussions with staff and <br />consultants following tonight's directives, to schedule the <br />appropriate and applicable meeting time. <br />Councilmember Ihlan reiterated her intent to receive the <br />
