City Council Regular Meeting - 08/09/04 <br />Minutes -Page 22 <br />Roll Call <br />Ayes: Maschka, Schroeder and Klausing. <br />Nays: Ihlan and Kough. <br />6.g Use of Eminent Domain Use of Eminent <br />[#3 -City Manager Bench Handout] Domain <br />Discussion ensued regarding the language for the motion, <br />and whether the constraints as listed by City Manager <br />Beets' suggested motions (Item 3, a, b and c) be <br />incorporated into the motion. <br />City Manager Beets reviewed the motion's intent, ranging <br />from general direction to more restrictive direction, as <br />outlined in conditions a, b and c. <br />Discussion ensued with the Master Developer as to the <br />amount of acreage currently under ownership of the <br />developer; with Mr. Noonan estimating that approximately <br />35 - 50 acres were currently under their ownership, with <br />several pieces fronting Cleveland Avenue available on the <br />market, pending tonight's Council actions. <br />Ihlan -this language is strong -RESOLVE to use ED if <br />necessary; don't know why we need to make any decisions; <br />many potential properties where ED may be requested; we <br />should determine ED on a case by case basis; don't see <br />purpose of any type of resolution along these lines; <br />inappropriate for us to make those promises <br />Kough - in past practice, RV got involved in one awhile <br />back; very costly; not sure I want to look at this concrete <br />position; individual parcel <br />Schroeder -there is no motion yet; if we don't use ED, or at <br />least think about it -use IF WE HAVE TO - if A,B,C have <br />been met - if we've exhausted every other avenue -let's <br />negotiate fair and square; <br />Further discussion ensued regarding wording and intent of <br />the motion. <br />
