City Council Regular Meeting - 01/30/06
Minutes - Page 9

7.

Consider a Request by Ron Anderson for a Final Plat for a
to-Lot, Single-Family Residential Development at 952, 960
and 978 Parker Avenue (PF 3665)
City Planner Thomas Paschke reviewed the request of Ron
Anderson for Final Plat approval of Birch Park, a residential
subdivision that redevelops 952, 960, and 978 Parker Avenue
into a ten lot, single-family residential development that includes
the construction of a public cul-de-sac street and public utilities
(sanitary sewer and water).

Mr. Paschke advised that staff recommended approval and
advised that each -of the proposed lots meets or exceeds the
requirements of the City Code regarding length, width, size and
required setbacks; and that the proposed road includes a 50' wide
right-of-way with a 28' wide road (back of curb to back of curb).
Mr. Paschke reviewed the ongoing work with Larson
Engineering and the Capitol Region Watershed District, and the
City's Public Works Department for creation of a storm water
management plan that addresses all concerns raised by
neighborhood residents and met all code requirements. Mr.
Paschke noted the development of the private storm water
management system and a homeowner's association to address
future concerns. Included in the information provided was a
January 25, 2006 letter from the Capitol Region Watershed
District regarding the proposed project.

Mayor Klausing questioned the City's recourse for enforcement
if the private homeowner's association should fail to perform as
outlined.

City Engineer Deb Bloom advised that the storm water plan, as
per code provision, required property owners to maintain those
structures in place; and between the City and developer
communication, and monitoring by the Capitol Region
Watershed District, a maintenance agreement would be in place.

Councilmember Ihlan addressed similar concerns about the
City's eventual enforcement power and whether the City could
be held liable if the drainage system was not maintained or

Ron Anderson
Final Plat for a t 0-
Lot, Single-Family
Residential
Development 952,
960 and 978 Parker
Avenue (PF 3665)
