City Council Regular Meeting - 11/08/04 Minutes - Page 26 City Attorney Anderson reiterated his opInIon that sufficient time was available at the Public Hearing, but that the City Council, staff, the petitioner and project proposer could use the time frame outlined to analyze the data and materials presented by each party. Councilmember Ihlan questioned the structure of the public hearing, and whether the Council would be hearing further public testimony; and again expressed her preference that the Council set aside a specific meeting for this matter. Councilmember Ihlan suggested that the date for reply be extended from November 17 to November 19. City Attorney noted that November 19, 2004 was a Friday, and staff needed time to prepare and distribute materials related to seven potential circumstances. City Attorney Anderson further noted the timing of the Public Hearing on November 22, 2004, in consideration of the Thanksgiving holidays, allowing an additional four extra days for preparation by all parties. Councilmember Schroeder questioned City Attorney Anderson whether the City Council could just take the appeal process directly to Ramsey County District Court now, rather than wasting more time. City Attorney Anderson responded negatively; noting that the City Council was the RGU. Discussion included the timing of the planning process based on the Environmental Review and the process. City Attorney Anderson advised he would prepare a written legal opinion as to the 60-day land use application process, but that it was a simple and straightforward process. Councilmember Ihlan reiterated her concern that, due to the Thanksgiving holiday, pushing the Public Hearing from November 22 to November 29, 2004, made more sense; moving the reply date to that Friday.
