Environmental Quality Board Rule

4410.3610, subpart 7

c. Total development within the area would exceed the
maximum levels assumed in the environmental analysis

document.

1. Yes, the total development within the area would

exceed the maximum levels assumed. The AUAR assumed 310

housing units and 240,000 square feet of retail space in this

area. The Rottlund proposal plans for 730 housing units and

330,563 square feet of retail space in this area. This is a 1360/0

increase in housing and a 380/0 increa'se in retail space.

Rottlund and city staff argue that since the Rottlund
proposal decreases the amount of office space, this only
represents a "shift in type of development," and that the
decrease "offsets" the increases in retail and housing. The
Environmental Quality Board interprets its rule quite
differently.
