City Manager Beets concurred, noting that at the time the record was compiled, staff did not have a physical record of Ms. Rattei's presentation; but following the hearing held on November 22, 2004, staff had made a photo copy of Petitioner representative and spokesperson Tam McGehee's presentation materials; and that presentation should include Ms. Rattei' s presentation materials as well as an attachment to the minutes under "Tab 16." Mayor Klausing, in his capacity as Chair of the Hearing, noted that he would interpret and review the presentation as part of the record, even if was received after the fact. Councilmember Ihlan specifically asked City Manager Beets if he had requested the letter from Barr Engineering. City Manager Beets responded negatively, that he did not request the letter, as clarified in his previous comments. Councilmember Ihlan expressed concern that the letter from Barr Engineering had been carbon copied to Mr. J ohannson, part of the development team; and questioned whether he had requested a copy of the letter. Councilmember Ihlan expressed further concern that, subsequent to Ms. Rattei's presentation, Mr. J ohannson may have called Ms. Rattei' s elnployer about her presentation; and if that was the case, it may have a chilling affect on people coming before the City Council to comment. Councilmember Ihlan expressed her desire that people felt free to provide information to the City Council, and questioned the appropriateness for people following up presentations with requests for letters such as the one from Barr Engineering.
