Legal Issues Regarding the Budget <br />City Attorney Scott Anderson provided an in-depth review, <br />as requested, on the respective authority of the City <br />Manager and the City Council in establishing positions, <br />hiring employees, providing raises, and making promotions. <br />information regarding the powers of the City Manager and <br />City Council. <br /> <br />Mr. Scott reviewed the City's status as a statutory city <br />operating under the Optional Plan B form of government, as <br />outlined in the Uniform Municipal Government Act, <br />Minnesota Statute Chapter 412; and as further defined under <br />the Roseville City Code. <br /> <br />Mr. Scott stated that, in his opinion, the Statute and City <br />Code left much room for interpretation, and reviewed in <br />detail his opinion dated January 9, 2003 entitled "Power of <br />Manager and Council." <br /> <br />Mr. Anderson stated that, overall under the auspices of these <br />documents, the City Manager has the right to fill or remove <br />someone from a position within the confines of the <br />established budget; and the Council's authority is a <br />legislative mandate in creating positions and fixing a <br />compensation range, with the City Manager making <br />recommendations to the City Council at his discretion, <br />during the year, or during budget negotiations. <br /> <br />Mayor Kysylyczyn expressed his appreciation to Mr. <br />Anderson for his detailed legal opinion. <br /> <br />Discussion items included the process defined for <br />combining or eliminating positions; established pay ranges <br />and revising salary levels; implications with labor <br />agreements, pay plans and merit systems; and impacts <br />regarding the State's Pay Equity system. <br /> <br />Mayor Kysylyczyn sought clarification on the availability of <br />the City's salary range. <br />
