<br />Regular City Council Minutes - 1/13/03 <br />Page 19 <br /> <br />Mayor Kysylyczyn spoke to the specific issue of <br />approximately one (1) year ago, where an employee's title <br />was Assistant Public Works Director, which was combined <br />and became the Assistant Public Works Director/City <br />Engineer, with a salary adjusted of an additional $9,000, and <br />his concern that that position change did not go before the <br />City Council for approval. <br /> <br />City Attorney Anderson responded to the Mayor's query <br />regarding whether that would be elevating someone to a <br />vacant position, by stating that the decision would depend <br />on whether duties were transferred from one position to <br />another or combined. <br /> <br />Mr. Anderson suggested that the Council concentrate more <br />productively on future personnel activities, given that his <br />opinion had just been rendered, and look to future issues for <br />further clarification during the process. <br /> <br />Mayor Kysylyczyn stated that his reason for this particular <br />question was due to concerns raised by people on the City <br />Council regarding whether there had been a violation of <br />law, and whether a crime had been committed with possible <br />theft or misappropriation of funds. <br /> <br />Mayor Kysylyczyn asked whether his proposed motion at <br />the December 16, 2002 Truth in Taxation Hearing had been <br />in order, given the legal opinion rendered by City Attorney <br />Anderson. <br /> <br />City Attorney Anderson opined that, under the <br />circumstances during the budget discussion, it was an <br />improper motion as it was amending positions, not dollar <br />amounts. <br /> <br />Kysylyczyn moved, Kough seconded elimination of the <br />position of Deputy Police Chief and the position of <br />Assistant City Manager. <br /> <br />Councilmember Klausing asked that additional information <br />be brought forward by the City Manager as to what <br />
