<br />E. How is a Special Service District Established? <br /> <br />The general procedure for establishing a special service district is as follows: <br /> <br />1. Council staff must propose an area for inclusion in a special service <br />district and communicate this in some way to the included property <br />owners. <br /> <br />2. The owners of twenty-five percent or more of the land area of property <br />that would be subject to service charges in the proposed special service <br />district and owners of twenty- five percent or more of the net tax <br />capacity of property that would be subject to service charges in the <br />proposed special service district must file a petition requesting a public <br />hearing on the proposed action with the city clerk. <br /> <br />3. The City must adopt an ordinance prior to establishing the special service <br />district. The ordinance must describe with particularity the area to be included <br />in the special service district, and the special services to be provided by the <br />district. 9 428A.02, subd. 1. <br /> <br />4. Prior to adopting an ordinance establishing a special service district, the City <br />must hold a public hearing on the creation of the service district and the <br />imposition of charges. 9 428A.02, subd. 1. <br /> <br />5. The City must publish notice of the public hearing in two issues of the official <br />newspaper two weeks apart. The hearing must be held at least three days <br />following the last publication. 9 428A.02, subd. 2. This notice must also <br />include the estimated cost of improvements to be paid by service charges <br />imposed and the amount of the proposed service charge. <br /> <br />, <br /> <br />6. Not less than 10 days before the hearing, notice of the hearing must also be <br />mailed to the owner of each parcel of property within the area proposed to be <br />included in the district, including tax-exempt parcel owners or property paying <br />on a gross earnings basis such as public utilities. 9 428A.02, subd. 2. <br /> <br />7. Notice of the hearing must include the time and place of the hearing, a map <br />showing the boundaries of the proposed district, and a statement that all <br />persons owning property in the proposed district that would be subject to a <br />service charge will be given an opportunity to be heard at the hearing. 9 <br />428A.02, subd. 1 <br /> <br />8. At the hearing, or before the ordinance is adopted, any affected landowner may <br />file a written objection with the city clerk asserting that the landowner's <br /> <br />3 <br />
