<br />Regular City Council Minutes - 3/17/03 <br />Page 13 <br /> <br />ordinance. <br /> <br />Acting Mayor Kough recognized Mr. Craig Piernot of <br />Outdoor Promotions, a potential shelter franchisee; and <br />Mr. Rol1ie Danielson and representatives of U. S. Bench, <br />currently a permittee in the city for bus benches. <br /> <br />In response to a query of Acting Mayor Kough, City <br />Attorney Anderson stated that, while this ordinance only <br />addressed shelters, not benches, the City may want to <br />review the potential of a franchise ordinance to address <br />benches, rather than current practice as dictated by State <br />Statute and City Ordinance No. 1267, Section 703.05, <br />specifical1y to address bus bench setback language in the <br />current code. <br /> <br />In response to Council questions and comments, City <br />Attorney Anderson reviewed various aspects of the <br />ordinance that attempted to address their concerns (i.e., <br />maintenance; advertising; and potential conflicts for <br />benches and/or shelters at one location). <br /> <br />Public Works Director Duane Schwartz sought Council <br />direction for staff to make future determinations based on <br />established criteria. Mr. Schwartz advised that under <br />current ordinance, co-location of benches and shelters <br />were not permitted. <br /> <br />Mr. Rol1ie Danielson, U.S. Bench, voiced his concerns <br />regarding language in the 2002 Council adopted <br />Ordinance No. 1267, and requested Council review of the <br />ordinance. Mr. Danielson asked that, given their <br />significantly different nature, the bench ordinance be <br />completely separated from the franchise ordinance. <br /> <br />Councilmember Klausing addressed Mr. Danielson's <br />concerns, as related to the requested action tonight for the <br />shelter franchise ordinance, clarifying that they were two <br />(2) separate discussions. <br /> <br />Further discussion included potential conflicts for shelter <br />
