<br />RULES AND DEFINITIONS
<br />
<br />2.1 RULES: rhe language set forth m the text of thIS Ordmance
<br />shall be mterpreted m accordance WIth the follOWIng rules of
<br />constructIOn.
<br />2.1.L The smgular number mcludes the plural and the plural
<br />the SIngular.
<br />2.12. The present tense mcludes the past and future tenses, and
<br />the future the present.
<br />2.1-3 The word "shall" IS mandatory, while the word "may" 18
<br />penUlsslVe.
<br />2.1.4. The masculIne gender mcludes the femlmne and neuter.
<br />2.1-5. Whenever a word or term defIned heremafter appears in
<br />the text of thIS Ordinance, Its meanmg shall be construed as
<br />set forth m the defInItion thereof, other words or terms shall
<br />be construed as havmg theIr common meanIng.
<br />2.1-6. All measured dIstances expressed m feet, shall be to the
<br />nearest tenth of a foot.
<br />
<br />2.2 DEFINITIONS: The folloWlng words and terms, wherever they
<br />occur m thIS Ordinance, shall be defIned as follows:
<br />2.2-1. Airport or Heliport. Any premIses which are used or In-
<br />tended for use, for the landing and take off of aU'Cratt, and any
<br />appurtenant areas WhICh are used or llltended for use for port
<br />buildings or other port structures or rIghts-of-way.
<br />2.2.2 Accessory Use or Structure. A use or a structure subordi-
<br />nate to the pnncIpal use or bwlding on the same lot and custo-
<br />manly InCIdental thereto.
<br />2.2.3. Alley. A public l'IIght.of-way. With a Width not exceeding
<br />24 feet nor less than SIxteen (16) feet WhICh affords a secon.
<br />dary means of access to abutting property.
<br />2.2-4., Apartment HoteL A hotel which contams dwellmg urots or
<br />dwelllllg umts and lodgmg rooms, and in which at least 50%
<br />of the gross floor area devoted to residential use shall be allo-
<br />cated to such dwelling umts. ServIces ordinanly furnished by
<br />hotels, such as drugstore, tea room, barber shop. newsstand
<br />when such are located entirely Wlthm the buildmg WIth no 5eR,
<br />arate entrances from the street, and haVIng no sign Of dlspla1
<br />VIsible from the outsIde of the building mdlcating the eXIstence
<br />of such use, may be furmshed.
<br />2.2-5. AutomObile Repair-Major. General repaIr, rebuildlllg or re-
<br />conditlOnmg of engInes, motor vehicles or traIlers, mcluding
<br />body work, frame work and palnting.
<br />2.2-6. Antxlanobile Repair-l\linor. Minor repaIrs, mCIdental body(
<br />and fender work. mInor pamtIng and upholtenng serVICe-, re-
<br />placement of parts and engIne serVIce to passenger vehicles
<br />and truck not exceeding three quarrer (3/4) ton capaCIty.
<br />2.27 Auto Rf~(,'tion Yard. An open lot or "ard when' three (3)
<br />or more unlicensed InotoI vehiCles 01 ul(; h::Uw..HI:; '.Le.(.U! <l~(
<br />kept for the purpose of dIsmantlIng, sale of parts, sale as
<br />scrap, storage or abandonment, except the storage of operatl'lie
<br />vehIcles In conJunctIOn WIth an established used auto and/or
<br />truck bUSIness or any other premIses used for wreckIng or stor-
<br />mg of motor vehicles not m runnIng conditIOn.
<br />2.2-8. Automobile Service Station (Gas Station). A place where
<br />gasolme kerosene or any other motor fuel or lubrIcating 011 or
<br />grease .for operatmg motor vehicles IS offered for sale to the
<br />public and delIvenes are made dIrectly mto motor vehIcles.
<br />2.2-9. Ba.sernent. A portion of a bwldmg located partly under-
<br />ground, but haVIng less than half Its clear floor to cellmg heI'
<br />ght below the average grade of the adJomIng ground.
<br />2.2-10. Boardinghouse (Rooming House). A bUIldIng other than
<br />a hotel where, for compensation and by prearrangment for de-
<br />.1Jrmte perIods, meals or lodgIng and meals are prOVIded for
<br />three (3) or more persons but not to exceed ten (10) persons.
<br />2.2.11. Building. Any structure for the shelter or enclosule of
<br />persons, ammals or chattels.
<br />2.2-12. Building Height. BUIldlllg heIght IS to be measured from
<br />the average establIshed curb level or from the average ground
<br />level at the buddmg Ime, whIchever IS higher, to the top of the
<br />cornIce of a flat roof, to the deck lIne of a mansard roof and
<br />to the mean dIStance of the hIghest gable on a pItched or hIp-
<br />ped roof.
<br />2.2.13. Bulk. SIgnIfIeS the SIze of bUIldings m terms of floor area
<br />and floor area ratIO, the location of bUlldmg walls m relatIOn to
<br />lot lInes and to extenor walls of other bUIldings, and the yards
<br />reqUIred under the terms of thIS Ordinance
<br />2.2-14. Cellar. That portion of the bUlldmg havmg more than half
<br />of the clear floor to ceIlIng heIght below the average grade of
<br />the adjacent ground
<br />2.215. Dog KenneL Any premIse where three (3) 01' more dogs,
<br />over four (4) months of age are owned, boarded, bred, and/or
<br />offered for sale
<br />2 2 16. Dwelling. A bUIldmg or portIOn thereof occupIed or In-
<br />tendcd to be occupIed exclUSIvely for reSIdence purposes, but

<br />quarters for one fanllly and not mOle than an aggregate of two

<br />2.218. Dnellmg, Attached. A dwellmg whlch IS JOIned to other

<br />2.2 19. DwellIng, SemI Detached. A dwelImg WhICh IS Jomed to

<br />2.220. Dwelhng, Detached. A reSIdentIal bUIldIng wlllch IS entIre-
<br />ly surrounded by open space on the same lot

<br />2.2-26. Floor Area, Gross .(for the purpose of determimng the

<br />2 2 27. Floor Area Ratio. The numencal value obtamed through
<br />dlVldmg the gross floor area of a bUIldmg or bUIldmgs by the
<br />net lot or parcel of land area On WhlCh such bUIlding or build-
<br />mgs are located.
<br />) I) 28. Garage. private, A detached accessory bUIldIng or por-
<br />tIOn of the prmclpal buildmg, mcludmg a car port, WhICh IS us-
<br />ed for stonng passenger vehIcles or trailer of the occUJpan1J
<br />and/or one huck of a rated capaCIty not m excess of one to one

<br />?229. Garage, Public. Any bUIldmg where automotIve vehIcles
<br />are pam ted, repall'ed, rebUIlt, reconstructed or stored for com-

<br />22 30. Ground Floor Area. The lot area covered by a bUllding
<br />measured from the extenor faces af exterIor walls but exclud-
<br />mg open terraces and garages.
<br />2.2 31. Home Occupation. Any gamful occupation engaged m by
<br />occupants of the dwellIng when occupation is conducted WIthin
<br />the pnncIpal structure of the prInCIpal structure becomes the
<br />base of operatIOn SubJect to stipulations as laid down In Sec-
<br />tIOn 5.11 of thIS OrdInance.
<br />2.2.32. Hotel. A bUIldmg whIch proVIdes a common entrance, lob-
<br />by. halls or staIrways, and m WhICh lodging IS offered with or
<br />Without meals to tranSIent guests.
<br />2.2-33. Junk Yard. An area where waste. dIscarded or salvaged
<br />matenals are brought, sold, exchanged, stored, boiled. cleaned,
<br />packed, disassembled or handled, mcluding but not lImIted to
<br />scrap iron, and other metals, paper. rags, rubber products, bot.
<br />tles and lumber Storage of such matenal in conJunctIon Wlth
<br />a manufactunng process when WltWn an enclosed area or build
<br />mg shall not be mcluded.
<br />2.2-34. Loading S~ A space. acceSSIble from a street, alley or
<br />way, In a building or on a lot. for the use of trucks while load.
<br />mg and unloading merchandISe or materials,
<br />2.2-35. Lodging Room. A room rented as sleepmg and livmg qu.
<br />arters, but WIthout cooking faCilities. In a suite of rooms with-
<br />out cooking facilIties. each room which proVides sleepmg ~.
<br />commodations shall be counted as one lodging room.
<br />2.2.36, Lot. A parcel of land, a1*1tting on a public street, being
<br />a lot designated m a recorded plat or a parcel OCCUPIed by a:
<br />pnncIpal buildIng upon the effective date of this Ordinance, or
<br />being a parcel of record of sufficient SIZe to proVide the yards
<br />reqwred by this Ordinance.
<br />2.2-37. Lot Arett.. The area of a hOrlzontal plane Wlthin the lot:
<br />lines.
<br />2 ~-38. Lot, Corner. A lot SItuated at the junction of, and abutting
<br />on two or more mtersecting sMets; or a lot at the point of de-
<br />flection In alignment of a SIngle street, the mterior angle of
<br />which does not exceed 135 degrees.
<br />2.2-39. Lot Depth. The mean horIZOntal distance between the
<br />front lot line and the rear lot lme of a lot.
<br />2.2-40. Lot, Interior. A lot other than a corner lot.
<br />2.2 U. Lot Line. A property boundary Ime of any lot held In sm.
<br />gle ownership, except that where any portion of a lot extends
<br />Into the abuttIng publIc street or alley. the lot lIne shall be
<br />deemed to be the street or alley line
<br />~ 2 42. Lot Line, Front. Tha t boundary of a lot which abutts a

<br />2.243. Lot Line, Rear. That boundary of a lot wWch lS oppoSIte

<br />In length, or If the lot forms a poInt at the rear, the rear lot
<br />lIne shall be deemed to be a lIne ten nO) feet m length Wlthm

<br />2.2 44. Lot Line, Side. Any boundary of a lot which IS not a front
<br />or a rear lot lIne.
<br />2.2-45. Lot, Through. A lot which has a pair of oPPOsite lot hnes
<br />along two substantially parallel streets, and which IS not a cor.
<br />ner lot On a through lot both street lines shall be deemed
<br />front lot lmes but m case of two (2) or more contIguous throu.
<br />gh lots, there shall be a common front yard
<br />2,246. Lot Width. The mean honzontal distance between the slde
<br />lot lines of a lot, measured WIthIn the lot boundaries.
<br />2.2-47. Mobile Home. Any type of structure ar vehicle which can
<br />be qUIckly adapted to or does prOVIde facilitIes for a person or
<br />persons to eat and/or sleep WhICh IS mounted on wheels, has
<br />provisions for wheels or may be loaded on an ordmary fiat bed
<br />truck, such as a house trailer, converted bus or truck, tent or
<br />small bUIldIng
<br />2.2.48. ~Iotor CoUI"t OJ' Motel. A building or group of buildings
<br />used prImanly for the tenlporary reSIdence of motonsts or
<br />travelers
<br />2.2 49. Motor FreIght Tel'lnlllal (Truck Tenn,inaJ). A buildmg lD
<br />WhICh freIght brought by motor truck IS assembled and sorted
<br />for routmg m lDtrastate and mterstate sWpment.
<br />2.250. NOn Conforming Structure. Any bUIldlDg or structure
<br />WhICh IS legally eXlstmg upon the effectIve date of thIS Zon-
<br />mg OrdInance, whIch does not conform to the applIcable con-
<br />dItIOns If the bUIldmg or structure was to be erected under the
<br />gUIdance of the Ordinance
<br />2.251. NOXIOUS Matter. Matenal WhICh IS capable of caUSIng lD-
<br />Jury or malaIse to hVIng orgamsms or IS capable of causmg
<br />detrunental effect upon the health, or the psychologICal, SOCIal
<br />or eConomIC well bemg of human beIngs
<br />2252. Nurse!'), Day. A 10catlOn where care IS prOVIded for pay
<br />for three (3) or more chIldren under kmdergarten age for per-
<br />iods of four (4) hours Or more
<br />2.253. Palking Space, Automobile. A SUItably surfaced and per-
<br />manently mamtamed area, eIther WIthIn or outSIde of a bUlld
<br />mg, of SUffICIent SIze to store one standard automobIle, but lD
<br />no event less than eIght and one half (8 ~) feet by twenty (20)
<br />feet WIth adequate aIsles for Ingress and egress A general
<br />standard of 300 square feet per space shall be used for com put-
<br />mg parkmg reqUIrements
<br />2.254. Person. An mdIvldual firm partnershIp, assocIatlOn, cor.
<br />poratlOn, or orgamzatlOn of any kmd
<br />2.255. Rest Home, (Nursing Home). A pnvate home for the care
<br />of chIldren or the aged or mflrm or a place of rest for those
<br />suffermg bodIly dIsorders SUch home does not contam eqUIp
<br />ment for surgIcal care or for the treatment of dIsease or mJury,
<br />nor does It mclude maternIty care or care of mental Illness.
<br />2.2-56. Set Back, Front Yard. The mInImUm honzontal dIstance
<br />between the front lme or SIde Ime of the bUIldmg and the street
<br />lme, dIsregardIng steps and unroofed porches.
<br />2.2 57. Stable, Private. Any bUIldmg located on a lot on WhICh a
<br />reSIdence IS located which IS deSIgned, used or mtended to be
<br />used for not more than four horses for the pnvate use of the
<br />reSIdents but shall not exceed 600 square feet m area.
<br />2.2-58. Stable, Public. A stable where horses are kept for remu.
<br />neratIOn, hIre or sale
<br />2.2-59. Stand,Roadside. A structure for the display and sale of
<br />products WIth no space for customers WIthm the structure it.
<br />self.
<br />2.2-00. Srory. That portion of a building included between the
<br />surface of any floor and the surface of the floor next abOve;
<br />
<br />or If there IS no floor above, the space between the floor and
<br />the ceiling next above. A basement shall be counted as a stOl'Yl
<br />and a cellar shall not be counted as a story.
<br />2.2.61. Street. Any publIc or prIvate way set aSIde as a perman-
<br />ent rIght of way for vehIcular access 40 feet or more III WIdtll

<br />2.2.62. StnlCtural Alteration. Any change, other than InCIdental
<br />repaIrs, m the supportIng members of a buildmg or structure,
<br />such as bearmg walls or petItIOns, columns, beams or gIrders
<br />or any substantIal chang~ Lfi the roof or extel'lor Walls
<br />2.2-63. Structure. Anythmg erected, the use of wInch reqUIres
<br />more or less peImanent locatIOns on the ground or attached
<br />to somethmg havmg a permanent 10catlOn on the ground.
<br />2.2-64. Trailer Park. A lot or parcel of land deslgned and mam-
<br />tamed for the purpose of accommodatIng those persons deSIr-
<br />mg a SIte upon WhIch to locate a traIleI as a shelter m which
<br />to lIve temporarlly or permanently, and saId SIte shall meet
<br />the mmlmUJU standards of the State Health Department for
<br />trculer parks.
<br />2.2-65. Uses, Non Confonning. Any use of a bUIldmg or premISes
<br />which. on the effective date of thIS Ordmance, does not. even
<br />though lawfully establIshed, comply WIth all of the applIcable
<br />use regulatlOns of the zOnIng distrIct In WhICh such building or
<br />premIses IS located.
<br />2.2.66. Yard. An open space on a lot whlCh IS unoccupIed and un-
<br />obstructed from ItS lowest level to the sky, except as othelWlSe
<br />pernutted In this Ordinance. A yard extends along a lot line
<br />and at l'lght angles to such lot Ime to a depth or Wldth speci-
<br />fIed m the yard regulatIons for the distnct In WhICh such lot
<br />Jslocated.

<br />GENERAL REQUmEMENTS
<br />
<br />:U APPLICATION: Except as heremafter prOVIded, no building

<br />3.2 NON.()ONFORMlNG USES:
<br />3.2-1 Any building, structure or use lawfully eXistIng at the time
<br />of enactment of thIS Ordinance may be continued at the size
<br />and m a manner of operation as eXIStmg upon the effective
<br />date of thIS Ordinance except as hereinafter speclf1ed. Noth-
<br />Ing In thIS Ordinance shall prevent the placmg of a building
<br />or structure m safe con~tIon when saId building or structure
<br />IS declared unsafe by the BuIldmg Inspector.
<br />3.2-2. Whenever any part of a buIlding, struct~re or parcel of
<br />land occupied by a non-conformmg use 1S changed to or replaG
<br />ed by a use confonmng to the prOVISIOns of this Ordiinance,
<br />such build mg. structure Qr parcel of land shall not return to
<br />the ongmal or any other non conformmg use.
<br />3.2 3. Whenever a non confoInUng budding or structure sha!I
<br />have been damaged by fIre. flood, explOSIOn, earthquake, war,
<br />not or other calamIty, It may be reconstructed and used as!
<br />before If It be completed WIthIn twelve (12) months after suchi
<br />calanuty, unless the damage to the building or structure was

<br />3.2.4. Whenever a non confornung use of a building, structure
<br />or land shall have been dIscontinued for a perIod of SIX (6))

<br />3.2-5. Any non confoInUng use af land not mvolvmg a buildmg
<br />or structure and any non conforming use mvolVIng a building
<br />or structure with an assessed value at the date of enactm.ent
<br />of this Ordinance of FIve Hundred ($500.()()) Dollars or less
<br />may be contmued for a penod of eIghteen (18) months after
<br />the enactment of thIS Ordmance, whereupon such non.con-
<br />formIng use shall cease The above regulation shall apply to
<br />SIgn boards and bIll boards which, If nat brought mto conform-
<br />ance. shall be removed from the SIte.
<br />3.2-6 Any bUIlding or structure WhICh will under thIS Ordmance
<br />become non conformmg but for whIch a pernut has been law-
<br />fully granted prIor to the effective date of thIS Ordinance or 01
<br />amendments thereto, may be completed m accordance Wlth the
<br />approved plans, prOVIded constructIOn IS started WIthin SIX 1(6)
<br />months of the effectIve date and continues to completIon with
<br />two (2) years. Such, shall thereafter be deemed a legally ex.
<br />Istmg non conformIng bwldmg or structure.
<br />3.2.7. A non conformmg use of a structure. buildmg or parcel
<br />of land may be changed to a SImIlar non conformIng use or a
<br />more restrIcted non conformmg use However, once a struc-
<br />ture, bUIlding or parcel of land has been placed In a more re-
<br />strictive non-conformIng use It shall not return to' a less re-
<br />strIctIve non conformmg use
<br />328 Normal mamtenance of a bUIldmg OJ other structures eon-
<br />tammg or related to a non conformmg use IS permItted, in-
<br />cludmg necessary non structural reparrs and mCldental altera-
<br />tlOns WhICh do not extend or mtenslfy the non conformIng use.
<br />3.2 9. AlteratlOns may be made to a bUIldmg contamIng non.
<br />conformmg reSidentIal umts when It Will Improve the lIvabilIty
<br />prOVIded It does not mcrease the number of dwellmg UnIts or
<br />bulk of the bUIldIng.

<br />3.3 LOT PROVISIO~S:
<br />3.3.1. A lot or parcel of land for WhlCh a deed has been recorded
<br />In the offlce of the Ramsey County Recorder upon, or pnor to
<br />the effectIve date of thIS 01 dmance shall be deemed a buIld-
<br />able lot prOVIded It has fIontage on a publIc nght of way andI
<br />said space reqUIrements for the diStnct m whlch It IS loca:te<ll
<br />can be mamtamed or adjusted to conform as follows:
<br />3.22. A platted lot or parcel of land of recOld upon the effec-
<br />tI\ e date of thIS Ordmance whIch does not meet the requll'~
<br />ments of thiS Ordmance as to area, WIdth or other Open space;,
<br />may be utIlIzed for smgle famIly detached dwellIng purposes;
<br />prOVIded the measurements of such area, WIdth or open space
<br />are wlthm 70% of the reqUIre ments under the terms of 1:hisI
<br />Ordmance but said lot or parcel shall not be more mtenslV~
<br />developed' Such eXlstmg lots that falI wIthm 700/0' of the re-
<br />qUIrements and have lot Widths less than 85 feet shall be per-
<br />mItted to have SIde yard set backs m the same percentage pro-
<br />portlOn as the lot WIdth reaches the 85 feet reqUIrement of
<br />thIS Ordmance In no case shall a Side yard set back be less
<br />than fIve feet.
<br />3.3-3. Where two or more contIguous vacant lots are held m
<br />SIngle ownershIp WIthIn a subdIVISIon which was duly recorded
<br />pnor to the effective date of thIS Ordinance, which lots are
<br />IndIVIdually not of the reqUIred mmnnum area or Width for
<br />the dIstrIct ill WhlCh they are situated. no specIal exceptiOll
<br />shall be reqUIred for the Issuance of bUIldIng permIts, prOVIded
<br />that such lots shall be developed In groups or fractIOns there-
<br />of, as smgle lots, to provide the mImmum lot frontage and
<br />area reqmred for each structure Th~ purpose Oif this provi-
<br />SIon is to permIt utIlIzation of isolated recorded lots which JacX
