<br />Regular City Council Minutes - 5/12/03 <br />Page 29 <br /> <br />City Attorney Anderson articulated his position in <br />representing corporate entities, as well as individual board <br />members; and the need for him to use his judgment in <br />whose interest he's representing. Mr. Anderson stated his <br />preference for ground rules in taking his direction from the <br />City Council as a whole in this item, given the issues <br />under consideration; and requested a motion to reflect that <br />direction to allow him to move forward and establish <br />procedure. <br /> <br />Maschka moved, Kough seconded, directing the City's <br />legal counsel to render an opinion involving all issues <br />regarding reimbursement of a Councilmember for legal <br />expenses. <br />Roll Call <br />Ayes: Maschka, Kough, Klausing and Schroeder. <br />Nays: None. <br />Abstentions: Kysylyczyn. <br /> <br />Councilmember Schroeder opined his support of <br />reimbursement of attorney fees for Councilmembers; but <br />spoke against the Mayor voting on the issue due to <br />potential conflict of interest concerns. <br /> <br />Councilmember Klausing clarified with Mayor <br />Kysylyczyn that his motion had been withdrawn. <br /> <br />Mayor Kysylyczyn withdrew his motion, but expressed <br />concern from past personal experience, that the process <br />could be lost in campaign rhetoric. <br /> <br />Kysylyczyn moved, Schroeder seconded, to direct staff to <br />put together information and prepare a detailed report on <br />costs involved in this issue during the entire process from <br />the Ethics Commission to present, including staff time, <br />Council time, law enforcement time and any other <br />incidental expenses related to this matter. <br /> <br />Councilmember Schroeder expressed support of the <br />motion. <br />
