Mr. Maas sought City Council <br />identification of the necessary steps and process required prior to <br />the School District selecting any developer. <br /> <br />Dan Colton, Environmental and Development Attorney, with <br />the firm of Leonard, Street & Deinard <br />Mr. Colton addressed those issues confronting the School <br />District; monitoring well and sampling done to-date; <br />groundwater sampling identifying the vertical and horizontal <br />extent of Volatile Organic Compounds (VOC's); and the <br />School's recent enrollment of the site in the Minnesota Pollution <br />Control Agency's (MPCA) Voluntary Investigation and Cleanup <br />(VIC) Program, identified as project No. 21420. Mr. Colton <br />noted the objectives of the Phase II investigation included further <br />delineation of the sources and extent of contamination of the <br />VOC's; determination of the direction of groundwater flow at the <br />site, including vertical and horizontal hydraulic gradients; <br />assessment of potential affects on localized groundwater flow <br />along the west side of Hamline Avenue and trends of <br />concentrations in groundwater; determination of any immediate <br />health and/or safety risks to human health or the environment as <br />a result of the VOC-affected soil and/or groundwater; and <br />provision of specific site information to determine if clean up of <br />the site is necessary based on the anticipated future use of the <br />site. Mr. Colton's six environmental investigations, from 1992 <br />- 2005, had been conducted at the site, and it was believed that <br />most of the shallow soil contamination was located under <br />buildings identified as Warehouse 1, with some under <br />Warehouse 2, and some under the paved parking lot; but that the <br />extent of groundwater contamination off-site was unknown at <br />this time. <br /> <br />Mr. Colton noted that the School District's objective was to <br />develop the property and clean it up to the standard of future <br />anticipated use (residential) with the oversight of the MPCA; <br />seeking their regulatory assurances that any future downstream <br />owners would be protected from any future liability; and that the <br />School District was seeking some grant monies to fund some or <br />all of the environmental clean up.
