Consider Extending the Hours of Operation for On- <br />Sale Liquor Establishments to 2:00 a.m. and First <br />Reading of a Corresponding Ordinance <br />Kysylyczyn moved, Kough seconded, first reading of an <br />ordinance entitled, "An Ordinance amending Title Three, <br />Sections 302.09 and 302.10, Hours of Sale and Evacuation <br />of On-Sale Establishments," allowing for a 2:00 a.m. <br />closing time for ALL days of the week. <br /> <br />Finance Director Chris Miller briefly reviewed the two (2) <br />ordinance options. as prepared by City Attorney Scott <br />Anderson. <br /> <br />Councilmember Kough sought Council consideration of <br />additional fees to provide revenue for additional <br />administration and policing costs. <br /> <br />Discussion ensued, including issues of the State- <br />implemented additional fee with those funds going to the <br />State Patrol, and fees based on the licensee's volume of <br />business; and whether the City was required to provide a <br />demonstration of incurred expenses. <br /> <br />City Manager Beets provided to-date information from the <br />League of Minnesota Cities (LMC) opining that the City <br />did not have a right to assess additional fees similar to <br />those legislated by the State. <br /> <br />Finance Director Miller advised that the City had twenty- <br />eight (28) 28 establishments; and the extended hours <br />would apply to on-sale AND 3.2 club establishments (i.e., <br />Midland Hills). <br /> <br />Consider Extending <br />the Hours of <br />Operation for On- <br />Sale Liquor <br />Establishments to <br />2:00 a.m. and First <br />Reading of a <br />Corresponding <br />Ordinance <br />
