Consider Extending the Hours of Operation for On- Sale Liquor Establishments to 2:00 a.m. and First Reading of a Corresponding Ordinance Kysylyczyn moved, Kough seconded, first reading of an ordinance entitled, "An Ordinance amending Title Three, Sections 302.09 and 302.10, Hours of Sale and Evacuation of On-Sale Establishments," allowing for a 2:00 a.m. closing time for ALL days of the week. Finance Director Chris Miller briefly reviewed the two (2) ordinance options. as prepared by City Attorney Scott Anderson. Councilmember Kough sought Council consideration of additional fees to provide revenue for additional administration and policing costs. Discussion ensued, including issues of the State- implemented additional fee with those funds going to the State Patrol, and fees based on the licensee's volume of business; and whether the City was required to provide a demonstration of incurred expenses. City Manager Beets provided to-date information from the League of Minnesota Cities (LMC) opining that the City did not have a right to assess additional fees similar to those legislated by the State. Finance Director Miller advised that the City had twenty- eight (28) 28 establishments; and the extended hours would apply to on-sale AND 3.2 club establishments (i.e., Midland Hills).
