<br />Regular City Council Minutes -7/28/03 <br />Page 12 <br /> <br />City Attorney Anderson advised that this ordinance was a <br />general ordinance, and that each franchisee would be <br />required to make application and an applicable and case- <br />specific agreement would be negotiated for each applicant. <br />After discussion, Mayor Kysylyczyn recommended <br />tabling action on this ordinance pending discussion on the <br />Bench ordinance. <br /> <br />Kysylyczyn moved, Maschka seconded holding a second <br />reading and enactment of an ordinance entitled, "An <br />Ordinance Amending Chapter 7, Section 703.05 of the <br />Roseville City Code Concerning Bus Benches." <br /> <br />Public Works Director Duane Schwartz advised <br />Councilmembers that the revised Ordinance provided <br />minor changes to make City Code Section 703.05, a stand <br />alone operating ordinance. <br /> <br />Discussion ensued regarding written request of a potential <br />franchisee, Outdoor Promotions, detailing their concerns <br />regarding bus bench ordinance language. <br /> <br />City Attorney Anderson suggested Council discretion take <br />precedence, rather than attempting to fine-tune an <br />ordinance for individual franchisees; allowing the Public <br />Works Director and Public Works and Transportation <br />Commission to determine the uniqueness of each proposed <br />location. <br /> <br />Mayor Kysylyczyll expressed concern at having the <br />discretion for siting dependent upon changing personnel <br />and Commission members. <br /> <br />Councilmember Schroeder reiterated his concern in not <br />co-locating benches and shelters related to ongoing <br />maintenance concerns and responsibilities. <br /> <br />Kysylyczyn withdrew his motion, and Councilmember <br />Maschka withdrew his second. <br />
