Special City Council Minutes - 07/31/03 <br />Page 10 <br />City Attorney Anderson sununarized the pertinent portions <br />of the discussion included instructing Mayor Kysylyczyn <br />to address any questions to the City Attorney personally <br />and in another venue, but not at the bench. <br />Payment of Legal Fees for Actions Taken While <br />Performing Duties as Mayor/City Councilmember, <br />(continued) <br />Acting Mayor Kough recognized Councilmember <br />Schroeder in an effort to return to the discussion of the <br />motion on the table. <br />Councilmember Schroeder requested the Recording <br />Secretary to repeat the motion. <br />Schroeder moved to approve the written request for <br />payment of the mayor's legal bill in the amount of <br />$17,802.91 under Minnesota Statute § 465.76; the bill <br />being properly itemized and detailed; and that the fees <br />and reimbursement are considered reasonable under <br />the facts and circumstances; noting that the case was <br />dismissed by a Ramsey County District Court judge; <br />and having reviewed the City Attorney's opinion dated <br />July 27, 2003. The motion was amended by Schroeder <br />as recommended by City Attorney Anderson to include <br />terminology that payment be subject to a pending <br />review and approval by the City Attorney as to the <br />reasonableness of the itemized billing. <br />Following the reading of the motion, Councilmember <br />Kough seconded the motion as amended. <br />Councilmember Maschka advised that he would not voting <br />in support of the motion at tonight's meeting; citing his <br />concern that Councilmember Klausing was not present to <br />provide input in this matter. Councilmember Maschka <br />further advised that he couldn't support the motion at <br />present due to his lack of information regarding the legal <br />counsel that was received by Mayor Kysylyczyn as to <br />whether he was told to vote or not to vote on the payment <br />of his own legal fees.
